The ABC has reported that the Defence Force Ombudsman has paid an additional $7 million to veterans following a review of decisions made under the Defence Abuse Reparation Scheme.

KSC Law was interviewed for the story because we have serious concerns about how that review was handled.

For some veterans, the first time they knew their case had been reconsidered was when they received an email saying their claim would be re-made.

Others may never have been told their matter was reviewed at all.

When a decision is reopened, particularly one involving serious abuse, trauma and lifelong harm, veterans should be told. They should have the opportunity to understand what is happening. And they should have the chance to obtain legal advice before decisions are finalised.

As I told the ABC, the handling of the internal review has not been managed very well.

This is not just about payment amounts; it is about whether veterans were given a fair, transparent process that respected their natural justice rights.

Many veterans who engaged with the Defence Abuse Reparation Scheme were already dealing with the ongoing physical, psychological and practical consequences of abuse suffered during service.

They deserved a process that recognised the seriousness of that harm.

Many former serving members are unaware that a medical discharge can give rise to significant benefits through their military superannuation scheme, including an invalidity pension and ongoing financial support.

Your entitlement will depend on factors such as your years of service, salary at discharge, medical conditions, and the military superannuation scheme you were a member of.

What many veterans don't realise is that they may have access to a range of entitlements and benefits through different systems, including:

• DVA (Department of Veterans' Affairs): providing compensation for service-related injuries and illnesses, funding for medical treatment and rehabilitation, incapacity payments for lost income, permanent impairment compensation, veteran payments, and support for dependants in some circumstances.

• CSC (Commonwealth Superannuation Corporation): administering military superannuation schemes and invalidity benefits for eligible former serving members who are medically discharged or unable to continue service.

• TPD Insurance: available through many superannuation funds and insurance policies, potentially providing a lump sum payment if an injury or illness prevents you from returning to work.

Depending on your circumstances, you may be entitled to compensation, healthcare, income support, superannuation benefits, or significant lump sum payments.

The Australian Government has announced funding of $16.6 million for an independent Inquiry into Military Sexual Violence in the Australian Defence Force, to be conducted by the Defence and Veterans' Service Commission (DVSC).

The Inquiry follows Recommendation 25 of the Royal Commission into Defence and Veteran Su***de and will examine the reforms needed to prevent, manage and respond to military sexual violence within the ADF.

The Royal Commission heard powerful evidence from serving and former ADF members about the devastating and lifelong impacts of military sexual violence. It found that military sexual violence disproportionately affects women and their families and is directly linked to su***de and suicidal distress. The Inquiry will consider reforms relating to prevention, survivor support, data collection and access to justice.

The biggest mistake veterans make with DVA claims?

Assuming they aren't eligible.

ADF culture teaches people to push through, minimise injuries, and get on with the job. For many veterans, that means they never even explore a DVA claim because they've already decided they aren't eligible.

"Others had it worse than me."
"It's just part of the job."
"I don't think my condition is serious enough."

Too often, veterans rule themselves out before DVA has even assessed the claim.

Many Australians are surprised to learn that they may already have life insurance through their superannuation fund. In fact, almost 10 million Australians have at least one type of insurance cover provided through their super. Most super funds offer default insurance, which can include Life Cover, Total and Permanent Disability (TPD) Cover, and sometimes Income Protection.
