From 1 October 2025, minimum pay rates are increasing for eligible employees in the aged care and health sectors, including direct aged care workers and some nurses. This change recognises the vital contribution of these roles and aims to ensure fairer pay across the sector. Employers should review their payroll to ensure compliance, and employees are encouraged to check how these changes may affect them

Minimum pay rates are increasing for eligible employees in the aged care and health sectors, including direct aged care workers and some nurses.

These increases apply from the first full pay period starting on (or after) 1 October 2025.

Note the full increase has already taken effect for some employees so they won’t receive any additional increase as part of these changes.

Even if you don’t have written policies, you are still legally responsible for meeting your obligations as an employer under the Fair Work Act 2009, Work Health and Safety laws, and other employment legislation.

Lack of documented policies does not remove your duty of care or compliance responsibilities. If something goes wrong — such as a workplace incident, dispute, or claim — you can still be held liable for breaching your legal obligations.

Every employee in Australia is legally entitled to the minimum pay rates and conditions set out under the Fair Work Act 2009 and the applicable Modern Award for their role and industry.

- Whether or not an Award is mentioned in an employment contract, it still applies by law if the work performed falls under its coverage
- Employers cannot contract out of or override Award conditions (like penalty rates, overtime, or allowances) — even if both parties agree.

This ensures employees are protected and businesses remain compliant with workplace laws. Failing to apply the correct Award can lead to:

- Backpay claims for underpayments
