What started eight years ago as a small, dedicated team supporting businesses with their people needs has grown into an award-winning boutique consultancy, partnering with organisations across Australia. While the business has evolved, the vision has not. We remain committed to providing thoughtful, strategic support that feels in-house, not outsourced.

As we begin to wrap up for the year, we wanted to share a message from our Founder and Managing Director, Natasha Silveira.

As the festive season approaches, we hope you’re able to take some well-earned time to rest, reset and recharge.

Our offices will be closed from 25 December to 11 January. During this period, we’ll have a skeleton team in place to ensure things continue to run smoothly.

We value the role we play alongside Australian businesses and look forward to continuing those partnerships, working closely with organisations across the country as a trusted HR, Payroll and Analytics partner in the year ahead.

Melbourne café operators hit with penalties over underpayments

The Fair Work Ombudsman has secured $28,171 in court-ordered penalties against operators and the manager of “The Colonel’s Son” café in Black Rock, Victoria, for breaching the Fair Work Act.

KRC Pty Ltd (the business operator) was fined $23,475, and the café manager, was fined $4,696.

The case followed a Compliance Notice which required the employer to calculate and back-pay entitlements to a full-time cook employed between February 2021 and February 2022.

The company eventually back-paid only $3,410, and only after legal proceedings had begun.

Key takeaways for small business:

1. Compliance Notices are not mere formalities, failure to act can lead to additional civil penalties on top of back payments.

2. Courts will impose significant fines to send a clear deterrent message to other employers.

3. Even if late payments are made, that doesn’t erase responsibility or avoid penalties.

Can you lawfully dismiss an employee on extended mental health leave?

A recent case involving a five-month mental health-related absence is a timely reminder; having a valid reason to dismiss isn’t enough, if you don’t follow the right process, you’re still exposed.

In this case, the employer had a valid reason to end employment: the worker was medically unfit to perform the inherent requirements of her role, and there was no realistic prospect of return.

But the process fell short.

Even when dismissal is justified, skipping steps can put your business at legal risk and undermine your workplace culture.

So what should you do?

✔️ Assess capacity with current, independent medical advice
✔️ Communicate intentions clearly and in writing, with an opportunity to respond
✔️ Follow a process that’s fair, transparent and well-documented
