Out of status in Canada? You may still be eligible for spousal sponsorship. 🇨🇦

Under the public policy based on section 25 of IRPA, certain genuine spouses or common-law partners living in Canada may still apply for permanent residence even if they have lost their temporary resident status.

However, being out of status does not automatically guarantee approval. You must still meet all other sponsorship and admissibility requirements, and every case should be assessed carefully.

Do not assume that losing your status means you have no immigration options.

Received an asylum claim ineligibility letter under the new Bill C-12 rules? Do not ignore your PRRA opportunity.

Many asylum claims are now being found ineligible for referral to the Immigration and Refugee Board under the new eligibility rules. In eligible cases, the person may later be given an opportunity to apply for a Pre-Removal Risk Assessment (PRRA) before removal from Canada.

A PRRA is not just another form. It may be your opportunity to explain, with strong and credible evidence, why returning to your country could expose you to persecution, torture, danger to your life, or cruel and unusual treatment.

Take this opportunity seriously. A poorly prepared application, weak evidence, inconsistencies, or missed deadlines can significantly affect the outcome of your case.

You cannot submit a PRRA simply after receiving an ineligibility letter. You must wait until CBSA formally confirms that you are eligible and provides the application instructions.
