Federal vs. Local Jurisdictions
1. Constitutional Nature of the Judicial System
The United Arab Emirates adopts a federal constitutional structure.
The UAE Constitution grants member Emirates the discretionary right to either integrate into the Federal Judiciary or maintain their autonomous local judicial systems.
Consequently, the judiciary is bifurcated into two distinct frameworks:
The Federal Judiciary:
Overseen by the Ministry of Justice, with the Federal Supreme Court (seated in Abu Dhabi) operating as the highest judicial authority.
The Local Judiciaries:
Independent judicial entities administered, financed, and operated autonomously by the respective local governments.
2. Geographical Distribution of Courts
The UAE Emirates are divided into two categories regarding judicial administration:
Emirates under the Federal Judicial System: Sharjah, Ajman, Umm Al Quwain, and Fujairah.
These Emirates have fully integrated their courts into the Federal Judiciary.
Emirates with Autonomous Local Judiciaries: Abu Dhabi (Abu Dhabi Judicial Department), Dubai (Dubai Courts), and Ras Al Khaimah (RAK Courts).
These Emirates maintain independent judicial councils and supreme appellate courts.
3. Substantive Laws vs. Local Legislations
Unified Substantive Laws: Principal federal legislations apply mandatorily and uniformly across all Emirates, irrespective of their judicial affiliation. Key examples include: the Civil Transactions Law, the Crimes and Penalties Law, the Commercial Companies Law, and the Labor Law.
Local Legislations (The Exception): Individual Emirates retain the legislative power to enact local decrees and regulations concerning matters not preempted by federal laws, or matters falling under their exclusive jurisdiction, such as municipal regulations, local fees, and real estate/landlord-tenant regulations (e.g., Dubai Rental Law).
4. Litigational Tiers and Ultimate Appellate Authorities
Under the Federal Judiciary:

Ultimate appeal before the Federal Supreme Court.
Under Local Judiciaries:
Court of First Instance
Court of Appeal
Ultimate appeal before the respective Court of Cassation (e.g., Dubai Court of Cassation). Judgments rendered by local Courts of Cassation are final and cannot be appealed before the Federal Supreme Court.
