TEMPLATE LETTER — REPRESENTATION AGAINST THE PROPOSED 10-YEAR ILR REQUIREMENT
Subject: Representation Regarding White Paper Proposal to Extend ILR from 5 to 10 Years — Request to Retain the 5-Year Route
Dear [MP’s Name] / Sir or Madam,
I’m writing as a resident of your constituency and a [Visa name] visa holder to formally express concern about the proposal set out in the May 2025 White Paper “Restoring Control Over the Immigration System”, which suggests extending the qualifying period for Indefinite Leave to Remain (ILR) from 5 to 10 years.
I moved to the UK in [Month, Year] and [began my / aiming to qualify for] 5-year pathway to ILR as a lawful resident. Like many others, I’ve fully complied with these terms, contributed to the UK economy, paid taxes, and invested socially, financially, and emotionally in building a life here.
The 5-year ILR route is not just a number, it reflects a fair and proven framework that:
Encourages long-term integration and planning
Rewards lawful compliance and contribution
Aligns with international settlement norms
Supports business retention of skilled workers
Helps immigrants become stable, productive members of society
The White Paper fails to confirm whether transitional protections will be offered for those already on this route, a silence that is causing widespread distress. Applying a 10-year requirement retroactively would not only breach the principle of legitimate expectation, but also raise serious concerns about proportionality and procedural fairness: all well-established grounds for legal challenge under UK immigration law.
I respectfully urge you to ask the Home Office:
Support the retention of the 5-year ILR pathway, which has proven effective and fair for both migrants and the UK
Call on the Home Office to confirm transitional protections for those currently on qualifying routes
Ensure a proper transition period, impact assessment, and legal scrutiny before any legislative changes are passed
I’m raising this now because policies like these can have long-term legal and personal consequences for people already on the 5-year path. The Home Office must understand the level of reliance and investment people like me have made under the current system.
With your support, the government will consider a fair and proportionate approach, one that retains the existing 5-year ILR route and provides transitional protections for those who trusted the rules in place when they arrived.
I would appreciate confirmation that this correspondence has been received and is being considered as part of the policy consultation process.
Kind regards,
