The decision of the Court of Appeal in Hirachand v Hirachand [2021] EWCA Civ 1498 # means claimants under the Inheritance (Provision for Family and Dependents) Act 1975 # ("IA") may have grounds for recovery of legal costs in pursuing their claim. This does not mean every claimant may succeed in recovery of certain legal costs.

Following a reported increase in the number of wills drafted in March 2020 and claims under the IA it maybe prudent to review existing wills and consider potential claims under the IA.
