In 2019 / 2020 an estimated 828,000 UK workers were affected by work-related stress, depression or anxiety, accounting for 51% of all work related ill health.

In Mhindurwa v Lovingangels Care Ltd, an employment tribunal held that a care worker was unfairly dismissed because furlough wasn't considered during the redundancy process.

The judge said that "I am of the view that in July 2020 a reasonable employer would have given consideration to whether the claimant should be furloughed to avoid being dismissed on the grounds of redundancy.”

This case was only a first instance decision and is therefore not legally binding on other employment tribunals.

It also does not state that the employee 'must' have been furloughed as an alternative to redundancy, rather that the employer should have 'considered' furlough.

⭐ The case serves as a useful reminder of the need to adopt a fair redundancy process ⭐

Furlough remains available until 30th September and employers should continue to take this into account in redundancy situations.

Did you know there are certain policies that employers are required to have by law?

⭐ Health and Safety: Every business must have a policy for managing health and safety. If you have five or more employees you must have a written policy which must be shared with employees.

⭐ Disciplinary & Grievance: The Employment Rights Act 1996 states that a written statement of employment particulars (contract) must include reference to any disciplinary, dismissal or grievance procedures, although the actual policies/procedures can be supplied elsewhere, such as in a staff handbook.

The following policies are also beneficial to ensure compliance with employment laws:

⭐ Data Privacy: When processing data you must tell people what you are doing with it. They have the right to know why you need it, what you'll do with it, and who you're going to share it with. It's best to have this written down in a document called a privacy notice.

⭐ Equal Opportunities: An equal opportunities policy can help prevent discrimination in the workplace by setting out standards and expectations to make sure employees are treated fairly and inclusively.
