New wording for Expert Witness's Statement of Truth A reminder to all solicitors that are currently instructing expert witnesses under CPR that from today PD35, paragraph 3.3 requires experts to include the following additional sentence in their Statement of Truth: “I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.”...

We have all seen an enormous increase in phishing emails since the start of the pandemic. For many of us our work involves multi £million dispute resolutions where clients expect communications to remain confidential or privileged. But many of us are still sending highly sensitive business information and bank account details in unencrypted emails. A reminder of the dangers came from a rather surprising source recently....

A two-tiered Board or more professional directors? Spectacular company failures are usually the catalyst for changes to company law. Familiar names such as BHS, Patisserie Valerie, Thomas Cook and Carillion have collapsed after auditors have given them a clean bill of health, even after significant frauds have remained undiscovered for many years. Why are we still sending unencrypted emails?

Clients still send me highly sensitive business information and bank account details in unencrypted emails. A reminder of the dangers has come from a rather surprising source - HM Revenue & Customs. I include their advice as well as the dangers of browsing suspect urls in my blog today. In summary, we need to check the sites we visit, only open emails from trusted sources, encrypt sensitive emails, documents and memory sticks, use password managers and a VPN to access office files when working remotely. I have greatly enjoyed being able to conduct meetings “virtually”. Often I find it far more interesting looking over the shoulders of those “present” to examine their surroundings. Whether dealing with colleagues, watching MPs put questions to the Prime Minister to a depleted House of Commons, or celebrities being interviewed from the comfort of their own homes, the benefit nobody has mentioned is the chance to peer into other people's homes.
Seeing the private space tells us so much about them. I was struck by how remarkably well decorated most homes seem to be! Most participants prefer to sit at desks in front of heaving bookshelves, as if to suggest how well read they are. Nobody conducts meetings from the comfort of a sofa or an easy chair.
It tells us so much more about people than seeing them in an office or studio. I shall miss these glimpses into others’ private lives when we are back at our desks.
