Big HR Changes Are Coming in 2026 – Retail Businesses, Take Note

As businesses start planning for 2026, the scale of upcoming UK employment law changes is coming sharply into focus — and for retail employers, the impact will be felt day to day in stores.

From April 2026 through to 2027, we’re looking at:
• Statutory Sick Pay payable from day one
• Rising statutory pay rates and the National Living Wage
• Day-one family-friendly rights
• Tribunal claim time limits extended to six months
• Fire-and-rehire effectively classed as unfair dismissal
• Tougher anti-harassment duties
• Unfair dismissal rights after six months
• Zero-hours reform, flexible working as default, and uncapped compensation

Individually, these changes are manageable.
Taken together, they significantly increase cost, risk and pressure on managers.

For businesses, the real risk isn’t bad intent — it’s:
✔ Inconsistent absence decisions
✔ Informal conversations becoming evidence
✔ Managers acting before checking
✔ Contracts and policies falling behind legislation

Sick pay changes are coming — and they’re big for small businesses.

From April 2026, new legislation will significantly widen access to statutory sick pay (SSP). This will mean higher costs and more admin for many employers, especially SMEs who don’t always have the buffer to absorb sudden increases in absence-related spend.

Here’s what’s changing from April 2026:
⚠️ SSP will start from day one — no more 3 waiting days
⚠️ No minimum earnings threshold — more workers will qualify
⚠️ Employees will receive 80% of pay or the flat SSP rate (whichever is lower)

In practice, this means over 1 million additional workers will become eligible for sick pay. For small and growing businesses, this is a material shift that needs planning.

But with the right systems in place, you can stay compliant, control risk, and protect your team.

What I recommend employers start doing now:
✅ Ensure your call-in procedures are clear and enforced — staff must report absence on day one
✅ Track absences properly — good records make all the difference
✅ Hold return-to-work discussions consistently to set expectations
✅ Review your absence policies, including triggers, timelines and documentation
✅ Make sure managers are trained to handle absence correctly and confidently
