One LPA does not cover every decision.

There are two separate types of Lasting Power of Attorney in England and Wales:

🏡 Property and financial affairs
This can allow your attorneys to manage matters such as bank accounts, bills, pensions, investments and property. Once registered, it may be used with your permission while you still have mental capacity.

❤️ Health and welfare
This can cover decisions about medical treatment, care, daily routines and where you live. It can only be used when you are unable to make the particular decision yourself.

You can make either type—or both—but one does not provide the powers included in the other.

What happens if the person you have chosen as your attorney can no longer act?

An attorney may become unable to act for several reasons—for example, if they die, lose mental capacity or decide to step down.

When creating a Lasting Power of Attorney, you can appoint one or more replacement attorneys to step in if an original attorney is permanently unable to continue.

Without a suitable replacement, an LPA may stop working entirely or become unusable for certain decisions. The outcome also depends on whether your attorneys were appointed jointly or jointly and severally.

Careful planning at the outset can help ensure that the people you trust are still able to support you when needed.
