BENCH WARRANT vs. ARREST WARRANT: KNOW THE DIFFERENCE.
Many people hear the words “bench warrant” and “arrest warrant” and assume they mean the same thing. While both authorize law enforcement to take a person into custody, they arise from different legal circumstances.
ARREST WARRANT
An arrest warrant is a legal order issued by a court authorizing law enforcement officers to arrest a person suspected of committing an offence.
It is usually obtained after a complaint, police investigation, or presentation of facts showing that there are reasonable grounds to believe that the person was involved in a crime.
Example:
If the police investigate an alleged theft and provide sufficient evidence to the court, the court may issue an arrest warrant directing officers to arrest the suspect and bring them before the court.
BENCH WARRANT
A bench warrant is an order issued directly by a judge from the courtroom (the “bench”) because a person has failed to comply with a court requirement.
It is not necessarily based on a new allegation of criminal conduct. Rather, it is often issued because someone DISOBEYED a court order or failed to respect the authority of the court.
Examples of situations that may lead to a bench warrant include:
✅ A defendant who fails to appear in court after being properly summoned.
✅ A witness who refuses to attend court despite being ordered to do so.
✅ A person who violates a court directive.
THE KEY DIFFERENCE:
An arrest warrant is commonly connected to an alleged offence and the investigation or prosecution of that offence.
A bench warrant is connected to a person’s failure to comply with a court process or instruction.
In simple terms:
An arrest warrant says: “This person is wanted because of an alleged crime.”
A bench warrant says: “This person must be brought before the court because they failed to do what the court required.”
The power of the court is not only in deciding cases; it also includes the authority to ensure that its orders and proceedings are respected.
