Europe is finally beginning to recognize statelessness as more than an immigration issue.

It is increasingly understood as:

a child-rights issue,
a family-law issue,
a civil-status issue,
and ultimately a question of legal identity.

But recognition alone is not enough.

Across Europe, authorities are becoming better at identifying statelessness and nationality uncertainty. Yet many children still remain trapped between legal systems that each assume another state should take responsibility.

A nationality that exists only in theory is not always an effective nationality in practice.

The new article examines:
• the growing European focus on identification and registration of statelessness,
• the limits of current EU and national procedures,
• the difference between theoretical and effective nationality,
• and why cross-border family cases expose structural weaknesses in modern legal systems.

The real challenge for Europe is no longer simply seeing statelessness.

The challenge is resolving it.
