市面上取巧,走法律罅的商人何其多,教你點睇裝修合約。

1. 必須要有完整設計圖(design drawings),副以文字清楚列明指定物料 (material specifications),及工程項目範圍(scope of works)

2. 要求用Lump Sum Contract,總額承包整個裝修項目

Lump Sum Contract 簡單說是承建商必需以合約列明的總額,承包設計圖紙,物料規範上列明的所有項目。雖然合約報價上仍然會列明各項工程數量及價格明細,但因為有圖紙及清晰工程項目範圍,承建商不得以合約數量錯誤(或所謂只作參考),最後埋單計數以重新量度為由,索取額外工程費用,換句話說,就算承建商在制定合約時自己量度錯誤,也要自己負責。除非顧客方面在合約簽訂後,在已協議的工程範圍以外,要求加改,或者減少項目。這時候合約上的項目單價才會派上用場。

這個被騙個案,正是奸詐商人,用「重新測量合同」(Re-measurement Contract) 形式。在合約上每項目並沒有反影真正數量,少量乘以單價,初步總金額當然顯得很小,實際上每項目單價可能已經比市價高出幾倍!到埋單計數,量度實際施工數量的時候,才知道墮入圈套已經太遲。而由於合約上,項目單價是雙方面你情我願同意簽訂的,一般鬧上法庭也不能幫顧客「平反」。
