A legal question that emerged while reviewing a surrogacy-law chapter opportunity.
Imagine this:
Vishnu Pratap and Veena are the intending parents, and Varsha is the surrogate mother.
During the course of the surrogacy, both intending parents die. During delivery, Varsha also dies — but the child survives.
This immediately raises a much larger legal question.
What happens to the child?
Unexpected death/separation of intending parents
↓
Both intending parents unavailable
↓
Surrogate unavailable
↓
Surviving child
↓
Legal parentage
↓
Immediate care
↓
Guardianship / child protection
↓
Long-term welfare
Once the child survives such a situation, what does Indian law provide for:
• immediate care
• legal guardianship
• financial support
• protection
• continuing rights?
And does the answer lie entirely within the Surrogacy (Regulation) Act, 2021, or does the situation require us to examine its interaction with child-protection law, guardianship, medical law, insurance and the best-interests principle?
The interesting part is that the existing framework does anticipate some individual contingencies.
So the question isn't simply:
“Is there a law?”
The deeper question is:
Are the existing provisions sufficiently connected, clear and enforceable when multiple contingencies occur simultaneously?
This is the kind of question that interests me in legal and academic research — not just identifying what a provision says, but examining how different legal frameworks interact when a real-world situation becomes more complicated than the original legal arrangement anticipated.
