TRADEMARK REGISTERED !!!
MSME - The Intellectual Property Facilitation Centre helped M/s.Dhaanyas to register a trademark (Dhaanyas Logo).
The Trademark “Dhaanyas” has been granted under Trademark Act, 1999 by the Trademark Registry on 6th June 2022. MABIF – IPFC also supports the reimbursement of up to Rs.10,000 towards Registration of Trademark.

The intangible asset Dhaanyas now belongs to M/s.Dhaanyas and it enjoys exclusive rights. Trademark Protection lasts for 10 years and then it can be renewed.

NABARD Madurai Agribusiness Incubation Forum has facilitated to file Geographical Indications (GI) tag for the Chettikulam small onion, with the support of applicants, the Tamil Nadu State Agricultural Marketing Board and the Chettikulam Small Onion Farmers’ Producer Association, Perambalur.

Chettikulam small onion is cultivated in Chettikulam village, Allathur block, Perambalur district. Every year, 70,000 tonnes of small onion are produced in over 12,500 hectares of land area here.
Due to the presence of high sulphur content in this region, this particular onion has the highest pungency taste when compared to the other variants. It has around 15-18 layers of dried outer scales. And has a shelf life of 8-9 months. It shows early sprouting compared to other small onion varieties.

This has recorded the highest plant height at all stages invariably of both seasons (Summer and Kuruvai). This Onion has a higher germination rate, this is the reason that almost 70% of the produce is used as a propagating material (as bulbs) in many districts of Tamil Nadu.

The Indian Registry has accepted the application for a Certification Mark applied by Silk Mark Organisation Of India for its Silk Mark Logo. However, this was accepted in violation of various provisions of the Trade Marks Act.

The Applicant did not file the draft regulation as mandated under Sections 71(1), 72(1)(b), and 74 of the Trade Marks Act. This has become a continuing issue at the Indian Trade Marks Registry. There are major lapses at the examination stage of Collective Marks and Certification Marks at the Registry.

Can you apply for a mark identical to a well-known mark in respect of disparate goods/services?

A well-known mark means a mark that is so well known for any good or service that if used in respect of a different good/service, people are likely to attribute a connection to the actual owner. For example, RAYMOND, BISLERI, BENZ, CATERPILLAR, ENFIELD BULLET, and KIT KAT are declared well-known

Declared well-known mark mandates enhanced
protection. For instance:
Proviso to S. 9 (1)-a well-known mark will overcome the limitations mentioned under S. 9 (1)(a), (b), and (c).

S. 11(10)-the Registrar must protect a well-known mark against identical or similar trademarks when considering an application for registration or in case of an opposition.

S. 11(2) bars the registration of marks that are identical/ similar to a well-known mark in respect of dissimilar goods/services.

S. 29(4)- an infringement action can be taken against identical/similar marks in respect of dissimilar goods/ services in the case of a well-known mark.

Once a mark is declared as well known, it is granted protection across classes. Therefore, it is advisable not to go ahead with the stunt of applying for an imitation of a well-known
