A consortium of six global investors has entered into a $20.7 billion agreement with Abu Dhabi National Oil Company (ADNOC).

As part of the agreement, the group will invest $10.1 billion to acquire a 49% stake in a newly-formed subsidiary, ADNOC Gas Pipeline Assets, with lease rights to 38 pipelines. ADNOC will hold the majority stake of 51% and will retain ownership of the pipelines. It will also manage operations and remain responsible for capital expenditure.

کنسرسیومی متشکل از شش سرمایه گذار جهانی موافقتنامه ای به ارزش 20.7 میلیارد دلار با شرکت ملی نفت ابوظبی (ادناک) امضاء کرده اند.

در بخشی از موافقتنامه، این گروه 10.1 میلیارد دلار برای به دست آوردن 49 درصد از سهام شعبه تازه تاسیس ادناک با عنوان «دارایی ‌های خط لوله گاز ادناک» به همراه حق اجاره 38 خط لوله سرمایه گذاری می کند. شرکت ادناک اکثریت سهام شعبه تازه تاسیس به میزان 51 درصد را در اختیار نگه می دارد و مالکیت خطوط لوله را نیز حفط خواهد کرد. این گروه همچنین عملیات ها را مدیریت می کند و مسئولیت هزینه های سرمایه ای را بر عهده خواهد داشت.

UNCTAD: How investment policies are responding to COVID-19

Countries are putting in place a variety of investment policies in response to the coronavirus pandemic. Such policies include facilitation and retention of investment, providing incentives, financial support to crisis-affected companies, supporting local small and medium-sized enterprises (SMEs) in supply chains, as well as protecting national security and public health through foreign investment screening.

According to the report, the global spread of COVID-19 is also impacting the negotiation of international investment agreements (IIAs).

براساس این گزارش، گسترش جهانی ویروس کووید-19همچنین بر مذاکره موافقت نامه های سرمایه گذاری بین المللی تأثیر گذاشته است.

Saudi investor buys mega farm in Australia

Saudi Agricultural and Livestock Investment Company (SALIC) ), an arm of Saudi Arabia's state-owned Public Investment Fund, has bought Baladjie farm in Australia extending to 200,000 hectares in the western wheatbelt for over AUS$ 60 million.
SALIC CEO said: “The acquisition of Baladjie is an important step for SALIC as we continue to build our global footprint in a meaningful way. It is our first acquisition in Australia as well as our first investment in sheep production.”

خریداری مگا مزرعه در استرالیا توسط سرمایه گذار سعودی

شرکت سرمایه گذاری کشاورزی و دامداری عربستان سعودی(SALIC)، که متعلق به صندوق سرمایه گذاری عمومی تحت مالکیت دولت عربستان سعودی می باشد، مزرعه Baladjie در استرالیا را به میزان 200،000 هکتار در نوار گندم غربی و با هزینه ای بالغ بر ٦٠ میلیون دلار استرالیا خریداری کرده است.
مدیر عامل شرکت SALIC گفت: «خرید مزرعه Baladjie گام مهمی برای SALIC است، زیرا ما به دنبال ساخت ردپای جهانی مان به شیوه ای معنی دار می باشیم. این اولین خرید ما در استرالیا و اولین سرمایه گذاری ما در تولید گوسفند است.

International Arbitration Tribunal Orders Venezuela to Pay ConocoPhillips $8.7 Billion

International arbitration tribunal constituted under the auspices of the International Centre for Settlement of Investment Disputes (ICSID) has unanimously ordered the government of Venezuela to pay ConocoPhillips the amount of $8.7 billion in compensation for the government’s unlawful expropriation of the company’s’ investments in Venezuela in 2007, plus interest.

دیوان داوری بین المللی ونزوئلا را به پرداخت ۸ میلیارد دلار به نفع کونوکو فیلیپس محکوم کرد

دیوان داوری بین المللی که تحت قواعد مرکز بین المللی حل اختلافات سرمایه گذاری (ایکسید) تشکیل گردیده است، به اتفاق آراء حکم داد تا دولت ونزوئلا مبلغ 8.7 میلیارد دلار را به کونوکو فیلیپس برای جبران خسارت ناشی از مصادره غیرقانونی سرمایه گذاری های این شرکت توسط دولت ونزوئلا در سال 2007، به علاوه بهره پرداخت نماید.

Iranian Company Wins $87mln Fraud Claim over Oil Rig Deal

A court in London accepted a claim filed by Iranian Offshore Engineering and Construction Company (IOEC) that it was a victim of a fraud in a 87-mln-dollar oil rig deal. Three main suspects of this case were sentenced to pay $87mln to the IOEC based on the court's ruling.
In 2011, sanctions made it difficult for IOEC to rent oil drilling rigs, so the IOEC approached Mr. Tabatabayee (one of three main suspects of the case) and asked him to find one to buy. Even though the rig was never delivered to Iran, IOEC ended up paying out all of the $87 million.

رای پرونده کلاهبرداری 87 میلیون دلاری دکل نفتی به نفع شرکت ایرانی صادر شد

دادگاهی در لندن ادعای اقامه شده توسط شرکت مهندسی و ساخت تاسیسات دریایی ایران را مبنی بر اینکه شرکت مذکور قربانی کلاهبرداری 87 میلیون دلاری در معامله دکل نفتی شده، پذیرفته است. سه متهم اصلی این پرونده بر اساس حکم این دادگاه به پرداخت ۸۷ میلیون دلار به شرکت مهندسی و ساخت تاسیسات دریایی ایران محکوم شدند.
در سال 2011، تحریم ها اجاره دکل های حفاری نفتی را برای شرکت مهندسی و ساخت تاسیسات دریایی ایران سخت نمود. از این رو، شرکت نامبرده از آقای طباطبایی (یکی از سه متهم اصلی پرونده) درخواست می نماید تا یک دکل نفتی برای خرید بیابد. هرچند دکل موردنظر هرگز به ایران تحویل داده نشد، تمامی مبلغ 87 میلیون دلار توسط شرکت مهندسی و ساخت تاسیسات دریایی ایران پرداخت شده بود.

Practical Meeting on Intellectual Property Claims

The practical meeting on Intellectual Property Claims was held at IranFIC office yesterday. Dr. Ali Tahvilian gave an introduction regarding the subject and then the discussion continued by participation of other members.
In order to make a claim regarding the intellectual property, since the lawsuit on the intellectual property varies according to the type of intellectual property, at first it is necessary to identify and determine the type of intellectual property, and then proceed with the claim. If possible, before making an action, try to resolve the dispute through negotiation and amicable means, and if no agreement is reached, the dispute can be referred to the competent court or the arbitration.

نشستی کاربردی در خصوص دعاوی مالکیت فکری دیروز در دفتر ایران فیک برگزار گردید. آقای دکتر علی تحویلیان مطالب لازم را در باب معرفی موضوع بیان نموده اند و سپس مباحثه با مشارکت سایر اعضا ادامه یافت.
برای طرح دعوی در خصوص اموال فکری، از آنجایی که طرح دعوی در خصوص اموال فکری متناسب با نوع مال فکری متفاوت می باشد، لازم است ابتدا نوع مال فکری شناسایی و تعیین و سپس براساس آن به طرح دعوی اقدام گردد. در صورت امکان پیش از طرح دعوی، از طریق مذاکره و شیوه های مسالمت آمیز برای حل اختلاف مطروحه اقدام شود و در صورت عدم حصول توافق، اختلاف مطروحه می تواند به دادگاه صالح یا مرجع داوری ارجاع گردد.

Turkey Ready to Launch Own SPV for Iran

By referring to INSTEX (Instrument In Support of Trade Exchanges), a new vehicle set up by the European Union to process payments outside the regular banking institutions, president of Turkey made the statement that: "Turkey is ready to join the SPV (special purpose vehicle) and create a similar bilateral mechanism for trade with Iran,".

رئیس جمهور ترکیه با اشاره به اینستکس (ابزار حمایت از مبادلات تجاری)، سازوکار جدیدی که توسط اتحادیه اروپا برای انجام پرداخت ها در خارج از سیستم معمول مؤسسات بانکی ایجاد شده است، اعلام کرده است «ترکیه آماده است تا به SPV (سازوکار ویژه) بپیوندد و یک مکانیسم دوجانبه مشابه ای را برای تجارت با ایران ایجاد کند.»

E3 joint statement on creation of INSTEX

France, Germany and the United Kingdom, in accordance with their resolute commitment to preserve the Joint Comprehensive Plan of Action (JCPOA) endorsed by United Nations Security Council resolution 2231, announce the creation of INSTEX SAS (Instrument for Supporting Trade Exchanges).
INSTEX will support legitimate European trade with Iran, focusing initially on the sectors most essential to the Iranian population – such as pharmaceutical, medical devices and agri-food goods. INSTEX aims in the long term to be open to economic operators from third countries who wish to trade with Iran.

فرانسه، آلمان و بریتانیا مطابق با تعهد خود به منظور حفظ برجام (JCPOA) که در قطعنامه 2231 شورای امنیت سازمان ملل متحد تأیید شده است، ایجاد اینستکس (ابزار حمایت از مبادلات تجاری) را اعلام نمودند.
اینستکس از تجارت مشروع اروپا با ایران حمایت خواهد کرد و در ابتدا بر بخش هایی که برای مردم ایران مهم است- مانند دارویی، دستگاه های پزشکی و کالاهای کشاورزی و مواد غذایی تمرکز خواهد کرد. اینستکس در بلند مدت در نظر دارد برای فعالین اقتصادی از کشورهای ثالث که مایل به تجارت با ایران هستند، اقدام کند.

Middle East oil investments to rise in 2019

Oil spend is expected to rise by nine percent year-on-year to $56 billion in the Middle East with expansionary projects such as Safaniyah, Marjan and Zuluf in Saudi Arabia.
Top regional gas projects that will drive growth include Egypt’s Zohr and West Nile Delta, Khor Mor in Iraq’s Kurdistan region and South Pars in Iran.
