On August 7th 2020 His Excellency president Muhammadu Buhari signed the Companies and Allied Matters Act (CAMA) 2020 into law.

This law makes it compulsory for all business Names to be registered.

Also under the CAMA, a registered business Name enjoys a corporate recognition and distinctiveness.

In that, no other name that is identical with or similar to the already registered Business Name will be subsequently registered by the Corporate Affairs Commission.

More importantly a registered business Name takes priority over an unregistered similar Business Name,

which in effect renders the unregistered Business Name unrecognizable in Law.

In other words if by chance someone registers that your name or a name that is extremely close to it before you do,

You will not be allowed to register that name again.

So you that is investing money into building your brand, printing business cards, you even went as far as using social media handles in announcing that name everywhere you go like MTN,

when you know fully well that you have not registered it.

what will you do, when the law tells you that you can’t use that name simply because someone else has registered it.

Think

The fact is that, for as long as you do not register that your business name, you give room for someone else to take your name.
