Today is the first wave of IEEPA tariff refunds court-ordered, Treasury-executed.
Most importers think the customs broker handles it. The CAPE portal, the declaration, file it and wait. That's the surface story. Here's what's actually true:

→ CAPE Phase 1 covers only ~63% of eligible entries. The other ~37% entries already liquidated beyond the 180-day protest window — have NO administrative pathway. They require litigation in the Court of International Trade. A broker cannot file in the CIT.

→ CBP has warned the court it faces "unprecedented volume" and that its existing systems are "not well-suited." Declarations get rejected on formatting errors, broker authorization issues, and IOR mismatches. A broker resubmits a spreadsheet. An attorney has legal recourse.

→ Companies that passed tariff costs through to consumers face a wave of class-action lawsuits when they file refund claims. Only an attorney can evaluate that exposure under privilege.
