🚨 YOUR I-485 COULD BE REJECTED BEFORE USCIS EVEN STARTS PROCESSING IT!

Don’t make this costly mistake.

Effective December 2, 2024, USCIS requires most Adjustment of Status (AOS) applicants to submit Form I-693 (Medical Examination & Vaccination Record) with Form I-485 when required.

❌ What if you don’t include I-693?

USCIS may reject your entire I-485 package instead of requesting the medical exam later.

That can mean:
📦 Your package is returned
⏳ Processing is delayed
📅 You lose valuable time
💵 You may face additional expenses

RFE vs. REJECTION

Previously, USCIS often accepted an I-485 and later issued an RFE for Form I-693.

Now, if I-693 is required but missing, USCIS may reject the filing outright.

🇺🇸 What about K-1 Visa holders?

Yes, this can apply—but there is an important exception.

Some K-1 entrants may not need a completely new medical exam, depending on:
• When the overseas medical exam was completed
• Whether it remains valid under USCIS rules
• Whether vaccination requirements are satisfied

In some cases, only the vaccination portion may need to be completed with a USCIS-designated Civil Surgeon. Every case should be evaluated individually.

U.S. CITIZEN? PLANNING TO BRING YOUR FIANCÉ(E) TO THE UNITED STATES? 💍❤️

Thinking about filing a K-1 Fiancé(e) Visa for the person you love in the Philippines?

Before you start gathering paperwork, make sure you understand one important thing:

📄 ORIGINAL DOCUMENTS vs. COPIES

Many U.S. citizens mistakenly send original documents to USCIS when copies are generally what should be submitted with the I-129F petition.

🇺🇸 USCIS – I-129F PETITION

For most supporting documents, USCIS generally requires legible copies, not your original civil documents.

❌ Don't unnecessarily mail your original birth certificate, marriage certificate, divorce decree, etc.

USCIS may request an original later if needed.

🇵🇭 NVC – K-1 CASE

K-1 fiancé(e) cases are different from CR-1/IR-1 immigrant visa cases.

NVC generally does not collect the complete civil-document package for K-1 cases. After processing, NVC forwards the case to the U.S. Embassy/Consulate where your fiancé(e) will interview.

🏛️ U.S. EMBASSY – INTERVIEW

This is where your fiancé(e) should be prepared to bring the original or certified copies of required documents, along with photocopies, according to the embassy's instructions.

⚠️ Requirements can vary by embassy. Always follow the most current instructions from the specific U.S. Embassy handling your fiancé(e)'s case.

U.S. Department of State – K-1 Fiancé(e) Visa

💡 Remember:
USCIS = Generally copies
NVC = Limited K-1 document collection
Embassy Interview = Bring required originals/certified copies

❤️ Don't let paperwork become the reason your journey takes longer than necessary.

ONE IMPORTANT EXCEPTION

Not every document follows exactly the same rule. Certain forms, evidence, sealed medical records, certified documents, original signatures, or documents specifically requested by USCIS/NVC/Embassy can have special requirements.

For example, NVC's instructions say not to send original documents unless specifically directed, and USCIS can request an original at any point during processing.

For an IR-1/CR-1 case in Manila, the safest rule is:

Submit copies/scans to NVC → keep your originals safe → bring the originals/certified copies to the Manila interview.

And importantly, don't mail your originals to NVC simply because the document was uploaded to CEAC. NVC specifically tells applicants not to do that.

Can I Apply for Adjustment of Status (I-485)?

Question:

"I'm currently in the U.S. on a B1/B2 visitor visa. I'm married to a U.S. citizen and we've already filed Form I-130. Can I now file Form I-485? Will it be a red flag because USCIS has already assigned a receipt number for my I-130?"

The Answer: It depends.

Simply having a pending or approved Form I-130 does not automatically prevent you from filing Form I-485 if you are otherwise eligible to adjust status.

However, USCIS will carefully review your case to determine whether:

✅ You were lawfully admitted or paroled into the United States.
✅ You are the immediate relative (spouse) of a U.S. citizen.
✅ You are otherwise eligible to adjust status under U.S. immigration law.
✅ You did not misrepresent your intentions when you entered the U.S. using your B1/B2 visa.

Will filing I-485 be a red flag?

Not necessarily.

The important issue is immigrant intent at the time of entry. If you entered the U.S. as a visitor while already intending to remain permanently, USCIS may question whether you misrepresented your purpose of travel.

On the other hand, if your plans changed after your arrival—for example, you and your spouse decided to pursue adjustment of status after entering the U.S.—that may be viewed differently. Every case is evaluated based on its specific facts and supporting evidence.

Before filing Form I-485, make sure your case is reviewed carefully.

An adjustment of status case involves much more than simply completing forms. Timing, eligibility, prior immigration history, and supporting documentation all play an important role.
