New Rules for Family Members Accompanying Workers in Sweden from 1 October 2026

From 1 October 2026, important changes to Swedish migration law will affect accompanying family members of work permit holders, EU Blue Card holders, ICT permit holders and researchers.

Our jurist, Rashid Mehmood, explains in his latest article the new rules and their practical implications, including:

* Maintenance requirements at the extension stage
* How the maintenance requirement is calculated
* Which household income may be taken into account
* The important distinction from the new 130% general family reunification requirement
* Specific rules for EU Blue Card and ICT families
* The separate maintenance requirement for family members of researchers
* New health insurance requirements in certain cases

These changes are particularly important for families already living in Sweden who will be applying for an extension after the new rules enter into force.

Successful Court Outcome: Refusal Decisions Set Aside and Case Returned to the Migration Agency

We are pleased to share a successful outcome achieved for our clients before the Migration Court in Stockholm.

Our jurist, Rashid Mehmood, successfully represented a family whose applications for residence and work permits had been refused by the Swedish Migration Agency.

The Migration Court set aside all three refusal decisions and returned the cases to the Swedish Migration Agency for further investigation and new decisions.

We warmly congratulate our clients on this positive outcome and sincerely thank them for placing their trust in us throughout the appeal process.

From Final Removal Decisions to 5-Year Residence Permits for the Whole Family

We are pleased to share a significant and emotional outcome for a family whose immigration case had reached a particularly difficult stage.

The family’s applications were initially refused by the Swedish Migration Agency. Their appeal was subsequently dismissed by the Migration Court, and the matter did not succeed before the Migration Court of Appeal, leaving the removal decisions final and enforceable. The family had already made arrangements to leave Sweden and were preparing for their departure.

Following important new developments in their circumstances, new residence permit applications were submitted. Our jurist, Rashid Mehmood, also submitted a request for inhibition of enforcement, asking the Swedish Migration Agency to suspend enforcement while the new applications were considered.

Shortly before the family’s planned departure, the inhibition request was granted and enforcement of the removal decisions was suspended.

Today, the family received the outcome they had been hoping for: their new applications have been approved and the whole family has been granted residence permits valid for five years.

The client was extremely happy and emotional when receiving the news, particularly considering the journey from final removal decisions and preparations to leave Sweden to a positive outcome for the entire family.

We warmly congratulate the family and sincerely thank them for the trust and confidence they placed in our jurist, Rashid Mehmood, and our firm throughout this challenging process.

A case that reached the end of the ordinary appeal process, but ultimately resulted in five-year residence permits for the whole family following new applications and further legal action.

Important Changes for Families of EU Long-Term Residents

From 1 October 2026, new rules will apply to family members of people who have long-term resident status in another EU country and are living in, or planning to move to, Sweden.

Key Changes

Children’s age limit

The automatic age limit for children has been lowered from 21 to 18 years. This means that children aged 18 or over will need to prove dependency in order to qualify as family members under another applicable legal basis.

Family must have lived together in the first EU country

The family must have been formed and lived together in the same EU country where the main applicant holds long-term resident status. Simply having a family relationship will not be enough. The family must also show that they actually lived together in that EU country.

Financial maintenance requirement

A maintenance requirement will apply. The person in Sweden must show that they have sufficient income or financial resources to support themselves and their family.

Transitional rule for extensions

If your current residence permit was issued before 1 October 2026, and you submit your extension application no later than 1 October 2027, your extension will be assessed under the previous rules. The new requirements will not apply to that extension.

In simple terms, two conditions must be met:

1. Your current permit was issued before 1 October 2026.

2. Your extension application is submitted by 1 October 2027.

No transitional rule for first-time applications

There is no transitional protection for first-time applicants. If you submitted your first application before 1 October 2026 but Migrationsverket has not made a decision by that date, the new rules will still apply to your application.

Effective date: 1 October 2026

SUCCESSFUL OUTCOME IN A COMPLEX ADULT DEPENDENT FAMILY MEMBERS
RESIDENCE CASE.

Our client's family has received a positive decision.
The entire family has been granted 5-year residence permits in Sweden, including two adult dependent children aged:

-26 years old
-23 years old

The family was initially unaware that their adult children could potentially qualify as dependent family members.
Our Jurist, Rashid, assessed their circumstances, advised the family on the relevant legal and documentation requirements, and helped them to prepare the cases accordingly.

The family ultimately received a positive outcome, with the whole family granted 5-year residence permits in Sweden.
