A trust provides implementable conditions even when the asset owner is still alive, while a Will cannot.

This is useful to clearly state your intention for distribution and will not be scrutinised by law publicly.

Knowing how to distribute your wealth to your loved ones will ensure their continuous stream of income.

We will usually advice our client’s that their child should inherit the assets monthly. This is because a lump sum will often result in unplanned spending and splurging which does not help in giving them a long term stability which you wish for.

We may thought that if we pass on, the law will automatically distribute our wealth to our loved ones. However, that may not be the case!

If your account is a joint account with someone who doesn’t contribute much to the asset, the joint account owner could potentially inherit the full amount instead of handing over to your loved ones.

This is just one of many reasons. If you like to find out more on how to distribute your wealth appropriately, do join our free education WhatsApp group where we will post bi-weekly on estate planning topics.

As much as the concerns of inheritance often deal with property, shares of a company, and other major assets and debts, it is also important to keep a lookout on other “Residual Items”.

This includes expensive jewelry, accessories, handbags, artworks, and other collectibles. Not stating how to distribute them clearly in your Will will only lead to disputes between your loved ones.

If you are unsure how to cover these areas in your estate planning, feel free to message us or book a call via our website at https://bit.ly/arklegacy

If you are a minor owner who might be wondering if you could receive part of the property, the answer is maybe.

This happens quite often for parents to give joint ownership of a property to the child due to them being “administratively out of choice” as their other favourite child has propert(ies) under their own name(s).

Being the main property owner, his/her intention could overwrite the minor owner.

To avoid unnecessary disputes, it is imperative that you, as a minor owner clarifies the intention and negotiate for a proper resolution indicated in the Will of the main owner.
