We had a meeting today (21/10/21) with the Ministry of Gender, Labor and Social Development (MoGLSD) and UAERA- Ugandan Association of External Employment Agencies as well as all recruitment agencies in Uganda
*The purpose of the meeting was to discuss the revised employment regulations* These were some of the things that have been modified below,
1. There must be training for all candidates to be deployed in the Middle East (training is mandatory
Recruitment companies have to submit lists of candidates to be trained using the ministry’s portal called EEMIS and the payment receipt must be attached to each candidate being trained.
*Note: *No candidate will be trained without proof of receipt/payment.
- Each candidate submitted for training *must have *valid passport* on Musaned.
The training of candidates, especially domestic workers, will take a period of 14 days, after which a training report is submitted, which is a condition for obtaining a permit.

2. The Ministry of Labor requires guarantees and guarantees for the safety of candidates. This is it
- Try to follow each candidate.
Ensure that all complaints of candidates are attended to
- Publish monthly reports on all candidates about their well-being
- Proof of residence of the candidates who can stay on arrival.
- In cases where the candidate is transferred from one employer to another, we must be informed of the new employer and the signed contract must be shared. No candidate may be transferred from one employer to another without the knowledge of foreign recruitment.

3. The employment agency must pay the Ministry for approval of the work order 200,000 Ugandan shillings per job application and this will be done before the work order is approved and will not be refundable.
4. INTERPOL certificates have been removed from the list of requirements for obtaining a permit but the Embassy of the Kingdom of Saudi Arabia still insists that they must be submitted for any candidate visa. The ministry has written an official letter to the Saudi embassy to allow us to submit the visa stamp without the Interpol certificate which they say they are still mediating.

* Any illegal investigation of a travel document will result in suspension or revocation of the recruitment firm's license.

🔥 _*Government Tightens Grip On External Labour Companies*_

The Ministry of Gender, Labour and Social Development seeks to tighten its grip on external labour export companies in fresh regulations for the recruitment of Ugandan migrant workers.

Titled, “The Employment (Recruitment of Ugandan migrant workers) Regulations 2021 Statutory Instrument 47 of 2021”, the regulation aim at among others revoking the Employment (Recruitment of Ugandan migrant Workers Abroad) Regulations, 2005, Statutory Instrument 62 of 2005, upholding the dignity and rights of migrant workers by prescribing the appropriate terms and conditions of their employment and providing mechanisms for regulating activities of companies and their agents.

The new regulations indicate that all shareholders and directors of a recruitment company in Uganda must be Ugandans contrary to the previous regulations, which only required half of them to be Ugandans. According to the proposal, the companies will also be required to have a minimum authorised capital of Shillings 50 million and a bank guarantee of Shillings 100 million up from Shillings 10 million and shillings 50 million respectively provided for in the 2005 regulations.

An additional requirement is prescribed for new companies to prove that they have a bank account balance of not less than Shillings 10 million while those in existence have to also submit to the Gender ministry verified financial statements, income tax returns for the preceding one year and an account balance of not less than 10 million Shillings.

Also, companies must apply for a license or renewal of the license by among others paying fees of Shillings 2 million. The application must include names and nationality of employees, directors and shareholders, their bio data, dates of employment, their tax returns for the preceding one year and clearance from the Criminal Investigations Directorate.
