📣 Important Reminder for Parents: The Significance of Prior Written Notice (PWN)
Be cautious of school districts and others who may prioritize their own agendas over your child’s educational needs. Sometimes, they create rules, policies, and procedures that are not aligned with the Individuals with Disabilities Education Act (IDEA) or that place unnecessary restrictions on parents and students.
One common practice that districts might use is related to Prior Written Notice (PWN), specified in 34 CFR 300.503. This crucial component of IDEA requires schools to provide parents with a formal notice when they propose or change a student's placement or when parents make specific requests for educational services, among other things under that law.
It’s important to know that while IDEA does not lay out a strict timeline for the district to provide a PWN, the longer it takes for them to issue this notice, the greater the risk of violating a student’s right to a Free Appropriate Public Education (FAPE). Delays can lead to serious implications for your child’s educational rights and serious consequences for the District.
