On the compliance conversation nobody wants to have

Twice this week, I had the same conversation with two people who don't know each other. One was speaking from a practitioner's seat — someone doing hands-on work inside an organization. The other was speaking from a funder's seat — someone responsible for deciding where support goes. Different vantage points, same underlying concern: leadership and program work moving forward on solid ground, while the compliance foundation underneath it is quietly cracking.

It's a pattern I keep running into from more than one direction. People are out in the field doing real, needed work — serving their communities, building programs that matter — but the systems underneath haven't kept pace. Nobody set out to neglect compliance. It just happens when the urgent work in front of you keeps winning out over the infrastructure behind you.

A significant number of nonprofit leaders treat compliance as the thing you get to once the "real" work is handled. Fundraising, programs, board development — those get the attention. Compliance gets the leftover bandwidth, if any is left at all.

But compliance is the soft underbelly of the sector. It's easy to overlook, easy to underfund, easy to assume someone else is watching it — until it's the thing that takes an organization down. A visionary leader, a strong board, a compelling program model — none of it protects you if the compliance foundation underneath has quietly given way.

If there's one thing three-plus decades in this sector has taught me, it's that the organizations that last aren't necessarily the ones with the flashiest programs. They're the ones who've reinforced the parts nobody sees.

If your compliance house isn't where it needs to be, that's not a verdict on your leadership. It's a fixable problem — but only if it gets named before someone else names it for you.

Every year around this time, nonprofit inboxes fill up with checklists — graphics templates, subject-line formulas, countdown calendars. All useful. None of it tells you whether your organization can actually handle what a strong campaign asks of it.

A strong push assumes a few things are already true: your board will show up and help carry the ask, not just watch it happen. Your financial systems can track revenues and expenditures and report every gift that comes in without someone scrambling in January. Your program story is documented well enough that a new donor understands the impact of their gift on the community and their social return on investment. Your organization has relationships beyond your usual circle to actually reach on December 1st.

If any of that gave you pause, that's useful information — and it's exactly what this month's theme is about. Before you touch a single graphic or write a single appeal, it's worth taking an honest, structured look at whether the systems underneath your fundraising are ready to support it.

Frankly, this isn't just about your own campaign anymore. Increasingly, funders — state agencies, foundations, and larger grantors alike — are requiring an independent capacity assessment as a condition of funding, or using the organizational capacity assessment as the entry point to determine the types and amounts of financial and other resources they will provide their grantees. What used to be optional due diligence is fast becoming the ticket to get in the room.
