One of the biggest bankruptcy stories of 2026 isn’t simply that filings are rising.
It’s where the growth is happening.
Through week 29, U.S. bankruptcy filings are up 12.1% year-to-date, with Chapter 11 filings up 21.1% outpacing both Chapter 7 and Chapter 13.
Subchapter V elections have also increased 50% year over year, while proposed legislation could raise the Subchapter V eligibility ceiling to $7.5 million.
At the same time, the data doesn’t support a dramatic shift toward Chapter 7 liquidation.
For bankruptcy attorneys, lenders, creditors, and legal teams, the important question isn’t simply:
“Are bankruptcies increasing?”
It’s:
“What is changing within the bankruptcy landscape and are you paying attention to it?”
