In light of recent events I feel compelled to write this post... The H2A program is for businesses to acquire temporary seasonal workers when they cannot find U.S. workers to fill their positions. It is for businesses that have a temporary recurring seasonal need. It is NOT an avenue to help illegals become legal. It is for the benefit of the employer. We go through the process of submitting to the state, then Department of Labor, running employment ads once DOL has accepted the file and then submitting to USCIS once DOL has certified the file. Once USCIS approves the business's application we can schedule appointments for workers at the U.S. Consulate. If the employer has specific workers they would like to request we will certainly schedule appointments for those workers. However, these workers will have their own interview at the U.S. Consulate and if they find that the workers have been in the U.S. illegally or have committed crimes they can/will deny the workers. This means that that specific worker cannot come on a visa but the company still retains that approved visa slot and can request a different worker (preferrably one that has followed the law if they hope to come on a visa). We have never and will never claim that we can get any company a specific worker as that is decided by the Consulate based on what they find in the worker's records. If we are made aware that any worker requested has issues this information is told to all employers.
