βš–οΈStarting February 24 at 12:01 a.m. ET, U.S. Customs will stop collecting tariffs imposed under IEEPA.

Here's what happened ⚠️ On Friday, the U.S. Supreme Court ruled 6-3 that the President's authority under the International Emergency Economic Powers Act (IEEPA) does not extend to tariffs. All tariffs imposed or modified under this act β€” including the "reciprocal" tariffs and fentanyl-related tariffs on China, Canada, and Mexico β€” are now invalid.

βœ…What brands need to know:

πŸ“Œ IEEPA tariff codes will be deactivated in CBP systems on Feb 24
❓What it means: The specific tariff classification codes (HTSUS numbers like 9903.XX.XX) that CBP uses to charge IEEPA-related duties will be turned off in ACE (Automated Commercial Environment β€” the system importers use to file entries). After Feb 24, importers won't have to declare or pay these tariffs.

πŸ“Œ An estimated $160B+ has been collected under IEEPA β€” refund procedures are still TBD
❓What it means: Since Trump started using IEEPA for tariffs, the government has collected over $160 billion from importers. Now that the Supreme Court ruled these tariffs illegal, importers may be entitled to refunds β€” but no one knows the process yet. The Court of International Trade will decide, and it could take months or years.

πŸ“Œ Section 232 and Section 301 tariffs remain in effect
❓What it means: Section 232 = National security tariffs (steel, aluminum). Still in place. Section 301 = Tariffs targeting unfair trade practices (most China tariffs from 2018-2019). Still in place. The Supreme Court ruling ONLY struck down IEEPA tariffs. Other tariff authorities are unaffected.

πŸ“ŒThe administration has already pivoted to Section 122 β€” a temporary 15% global tariff for 150 days
❓What it means: Trump Administration immediately responded to the ruling by invoking a different law β€” Section 122 of the Trade Act of 1974 β€” which allows the President to impose temporary tariffs (up to 15% for up to 150 days) to address balance-of-payments issues.
