A person accredited under a Community Safety Accreditation Scheme has to be assessed as suitable to exercise their extra powers, trained in their use and capable of carrying them out. The Act also requires that the organisation employing an accredited person must be 'fit and proper' and that they must have a satisfactory complaints procedure in place.[3]

An accredited person remains under the control of their normal employer, and is not managed by the police force. Therefore if an accredited person breaks the law, their employer, rather than the police, could be sued.[4]

The law requires that an accredited person wears a uniform approved by the police when exercising their powers, and that they also carry with them a badge with the logo shown and detailing the powers which they are entitled to exercise.

Just this passed weekend their was another shooting inside a night club in the city of Ft. Lauderdale! Lockdown security make it our business to proprely patdown and use our metal detector on every preson that comes inside the building. You will NOT!!!! have that problem when you use our severices. A number of the businesses were found to be in violation of PSISA provisions.

The charges included:

• 16 counts of working as an unlicensed security guard;

• 22 counts of employing an unlicensed security guard;

• seven uniform violations;

• seven counts of being an unregistered business, and

• two counts of operating an unlicensed business entity.

A total of two charges were laid in Woodstock – one count of working as an unlicensed security guard and one count of employing an unlicensed security guard. The police filed 17 charges in Owen Sound, 19 charges in Orangeville and 12 charges in Hamilton.

The investigations are continuing, which means further charges may be pending.

Under the PSISA, individuals performing security work in Ontario must be licensed. Establishments that employ in-house security must also be registered with the private security and investigative security branch.

Businesses that provide security services must be licensed by the ministry and are responsible for ensuring their employees are licensed. Persons convicted of working as unlicensed security guards can face fines up to $25,000 and, under the legislation, serve up to one year in prison.

Police have laid a number of charges for unlicensed security guards following a crackdown Friday night into early Saturday morning. Fifteen security guards were charged and a number of establishments were involved.
