Here's the real question now sitting with the European Court of Justice:

Can a country take away EU citizenship โ€” because that's what Italian citizenship is โ€” from someone who already held it from birth?

That's the heart of it.

โ†’ Italy's position: nothing is being taken away. The rules for who qualifies are simply changing going forward.
โ†’ The challengers' position: you can't retroactively erase a right someone was already born with.

If you're descended from an Italian emigrant, your Italian citizenship was never only Italian. EU citizenship came attached to it.

Europe's answer decides which reading wins. It could take a year or more โ€” and until then, cases like these stay frozen.

Italy's Supreme Court has settled it for good. It's called the "minor issue."

If you were born abroad, already Italian and American from birth, your parents becoming U.S. citizens does NOT take away your Italian citizenship. For two years a government circular said the opposite โ€” and many applications were rejected because of it. The Court has now confirmed that reading was wrong.

So if your case was ever denied, it's worth a second look.

Italy's Supreme Court just resolved the "Minor Issue" โ€” the question of whether children born abroad with dual citizenship from birth could lose their Italian citizenship because a parent later naturalized elsewhere.

The answer, from the Joint Civil Sections: no. Article 7 protects them. It always did.
