Everything You Wanted to Know About Legal Non-Compliance But Were Afraid to Ask

This year’s A&WMA Legal Workshop will focus on addressing the challenge of non-compliance, including techniques and strategies for:

(1) Identifying Non-Compliance,
(2) Responding to Non-Compliance,
(3) Managing Disclosures, and
(4) Resolving Non-Compliance.

Among other things, the seminar will address how to manage risk associated with discovered non-compliance, including how and whether to approach regulators, how to undertake a proper investigation, how and when to use audits and audit privilege as a tool, and negotiating compliance agreements.

The 2015 AWMA Legal Workshop will be held on Wednesday, September 16th (2015) and will feature Jon Bloomberg and William (Bill) Hefner, both of the Environmental Law Group. The event will focus on addressing the challenge of non-compliance, including techniques and strategies for the following:

A&WMA UMS -Informational Session on the Coal Combustion Residuals Rule

On August 27, 2015, Roger Clarke of Xcel Energy--and the A&WMA Upper Midwest Section Waste Committee Chair--will be present a summary of the final, adopted rule for the management of Coal Combustion Residuals (CCR), commonly known as coal ash, from coal-fired power plants. The presentation will address the provisions of this new federal rule, will constract it to the provisions of the Minnesota state program, and will discuss some of the potential challenges in implementation.


This rule, adopted as final on April 17, 2015 by the United States Environmental Protection Agency (US EPA) establishes technical requirements for landfills and impoundments that are used for the storage and/or disposal of CCRs. Under this rule CCR landfills and surface impoundments will be regulated under subtitle D (non-hazardous waste of the Resource Conservation and Recovery Act (RCRA) and establishes criteria for the beneficial use of CCRs.

The final CCR rule is a self-implementing rule. This means that affected facilities must comply with the new regulations irrespective of whether a state adopts the rule. The rule does not require regulated facilities to obtain permits, does not require the states to adopt and implement the new rules, and cannot be enforced by the EPA. Instead, the rule’s only compliance mechanism is for a state or citizen group to bring a RCRA Citizen suit in federal district court. In states such as Minnesota, with a robust program, affected facilities will need to meet the provisions of the state and federal program.

The Upper Midwest Section (UMS) of Air & Waste Management (A&WMA) is offering financial support to members who will be formally participating in the 2015 A&WMA Annual Conference and Exhibition (ACE). This year’s ACE will be held June 22-25 in Raleigh, NC. Those members who will be presenting a paper, displaying a technical poster, or participating in a technical planning committee are eligible to receive up to $500 in financial support. This includes students that participate in the Student Poster Competition or in the Environmental Challenge International (ECi) Competition. You must be a current A&WMA member to be considered for the financial support. The full details of the financial support policy are listed below.

If you believe you qualify and would like to apply for 2015 ACE support, please email your request to Jonathan Amos ([email protected]) by May 15, 2015. We anticipate making a decision, and informing recipients, the week of June 1, 2015.

Young Professionals Business Etiquette Seminar

How you present yourself to others in the business world speaks volumes. Learn about how to form a good first impression and what to do to ensure you are properly present yourself as a professional. This seminar will review how to make a positive first impression, tips for communicating effectively and other rules for thriving in the working world.

Notice on Financial Support for 2013 ACE Presenters

Similar to last year, UMS A&WMA is considering offering some limited financial support to members who will present a paper or who are part of a technical planning committee requiring their attendance at the 2013 ACE. This offer is limited to the 2013 ACE, which will be held in June.

Please review the A&WMA Board Policy you recieved via email; and, if you believe you qualify and would like to apply for 2013 ACE support, please email your request to Jonathan Amos ([email protected]) by May 10, 2013. We anticipate making a decision, and informing recipients, the week of May 27, 2013.
