Compliance teams have been asking us the same ten questions all summer. Here are the straight answers on the CFPB's 2026 mortgage rule changes.

β€’ Is disparate impact really gone from ECOA? Yes under federal law β€” but check your state.
β€’ Should we shut down statistical fair lending testing? No β€” re-tier how you act on results.
β€’ Has the Reg X loss mitigation overhaul been finalized? Not yet, but it's the one most likely to finalize before year-end.
β€’ Is the trigger lead restriction still in effect? Yes β€” verify your consent capture.
β€’ What's the 2026 HPML threshold? $34,200.
β€’ Should we expect fewer CFPB exams? Don't count on it β€” exam weight shifts to state and other prudential agencies.
β€’ What happened to SPCPs? New guardrails β€” get legal review if you operate one.

The single most important thing to do this quarter: build a regulatory change log with one owner per item. The lenders who get exam findings this cycle won't be the ones facing the most change β€” they'll be the ones who never assigned clear ownership for tracking it.

The CFPB's 2026 regulatory agenda is out. Five mortgage rules compliance officers need on their Q4 calendar.

1. ATR/QM reconsideration β€” upgraded from long-term to active pre-rule status
2. TRID disclosure timing review β€” flagged for reform by EO 14393
3. Points-and-fees thresholds for small-balance loans
4. Regulation X servicing overhaul β€” most likely to finalize first
5. Larger participant NPRMs β€” including consumer reporting market
Smaller item: 2026 HPML special appraisal threshold is now $34,200 (up from $33,500). Verify your LOS reflects the current number.

All of this is happening against a CFPB operating with constrained resources. Reduced Bureau capacity likely means more reliance on state regulators and other prudential agencies for exam coverage.

Why QC is a risk strategy, not just a checkbox

Quality control isn't just something you do to check a box for your investors β€” it's your first line of defense against repurchase risk, agency fines, and regulatory exposure.

At SimplifyQC, we help lenders build QC programs that actually catch defects before they become expensive problems β€” from pre-funding reviews to post-closing audits to MERS compliance checks.

A strong QC process protects your bottom line and your reputation. Is yours doing both?

The CFPB's Regulation X servicing overhaul is still pending β€” but it could publish any week.

The proposal would eliminate the "complete application" framework, replace it with a continuous loss mitigation review cycle, and pull foreclosure procedural protections forward to the borrower's initial request.

If your loss mitigation process is built around the current rule, you're not ready for the one that's coming.

Five things to do before the final rule publishes:
1. Map your workflow against the proposed continuous review cycle
2. Inventory state-by-state loss mitigation requirements
3. Review early intervention notice templates
4. Build Spanish-language communication capability
5. Brief your board on the scope of change

The CFPB's amended Regulation B has been law for two months. Is your fair lending QC program updated?

The April 2026 final rule (effective July 21) removed the "effects test" from ECOA and stated the statute does not recognize disparate-impact liability. The discouragement standard narrowed, and Special Purpose Credit Programs got new guardrails.

If your testing methodology still references the old effects-based framework, you have findings waiting to happen.
The right move: re-tier how you act on results. Keep statistical testing as an internal risk indicator that triggers deeper review. Reserve remediation for actual differential treatment or documented intent.

Five things to do before Q4 exams:
1. Update your fair lending policy to the disparate-treatment-only standard
2. Re-run your last two quarters of testing through the new framework
3. Audit any active SPCP for prohibited common characteristics
4. Review loan officer scripts and ad targeting
5. Confirm state-level fair lending exposure hasn't shifted
