Summary of the President's Executive Action on Immigration - Business Immigration.

Certain investors will be eligible for parole into the United States. (Current situation: only citizens of certain countries that have bilateral investment treaties with the U.S. are eligible for an investor visa E-2 based on relatively small investments; for citizens of all other countries, investment-based immigration is limited to the EB-5 program which requires investments of $500,000 or $1,000,000).

Broader availability of National Interest Waivers for entrepreneurs, researchers, inventors and startup founders. (Current situation: National Interest Waiver are already available to people whose work substantially benefits the United States, but the requirements are extremely demanding and the application of these requirements by USCIS very restrictive).

Employment authorization for some H-4 visa holders (spouses of H-1B visa holders) – this will be very beneficial for many families who are now forced to live on one income for years.

Ability to apply for adjustment of status ("green card") while waiting for the priority date to become current: This would be a tremendous benefit for EB-3 professionals and skilled workers, as well as for EB-2 immigrants from India and China, who now have to stay on H-1B visas for many years after their labor certifications are approved, because of quota backlogs. If this new rule is implemented, these people will be able to apply for adjustment of status much sooner. Although they won't get their green cards faster, they will enjoy many benefits of a pending adjustment application, such as an open market employment authorization for the applicant and all family members, and the ability to port the application to a new employer or self-employment in the same or similar occupation, without the need for a new labor certification.

Foreign graduates of U.S. universities in STEM fields will be eligible for additional extension of OPT time (currently, 17 months on top of a general 1-year OPT).

Summary of the President's Executive Action on Immigration.

The President's speech yesterday was only a brief overview of the upcoming administrative developments in the immigration arena. The government will issue clarifications and memoranda in the coming weeks. A few areas in which we should expect changes are: Deferred Action for Parents - employment authorizations for people who have been here for five years and who have children of any age with U.S. citizenship or permanent resident status; expansion of DACA (deferred action for childhood arrival) - this measure was introduced a couple of years ago and will now cover more people; focus on deporting dangerous criminals, suspected terrorists and recent illegal entrants (this, in theory, should translate in less deportations); and some important business related developments that I’ll discuss in a separate post.
