Workplace Violence: If you are a health care employer as defined in the new regulations (Title 8, Section 3342), beginning April 1st you will need to keep a “violent incident log” listing all incidents, post-incident response and investigation of a workplace violence injury, based on information from the employees who experienced the workplace violence. Read Section 3342 for details.

It has been a fun week with new experiences. Last night I was the speaker at a meeting of the Society of Excellence in Human Resources at CSU - Fullerton. I shared a Practitioner's Vision for HR with the students. Then this morning I provided a webinar on Mitigating Exposure and Risk when it comes to independent contractor classification and on California's Fair Pay Act. And, if you didn't know, at the first of the year there will be an expansion of the Act. The next webinar will be in January to review what else is changing in 2017! Join in!

Hi, All: In case you know employers in the City of Los Angeles, be sure they know that effective 7-1-16 LA has their own sick leave law, more generous than the State, and they have accelerated the increase of the minimum wage for employers with more than 25 employees. If your colleagues want to call for details it's OK to give them my office number 949-429-6818. These laws were just changed this month so implementation has to be swift.

Lots new lately. Be sure you're on top of things:
I-9 Form - All U.S. employers must complete and retain a Form I-9 for each employee hired. While the form expired last month, the new form has not been issued. Keep using the current one until we have a revised I-9.
CA Pregnancy Discrimination Poster - If you have five or more employees and, therefore, are covered by CA’s pregnancy disability leave law, you’re required to post the updated Pregnancy Disability Leave notice as of April 1st. Harassment and Discrimination - Businesses in California with at least five employees must now have a written anti-discrimination and anti-harassment policy by April 1, under new FEHA regulations. Many of you developed an employee handbook with me, but we will have to update that policy.

Reminder: OSHA Log 300A - If your business is classified in a specific industry group listed in Table 1 on this site: https://www.dir.ca.gov/t8/14300_2.html;
And/Or
If you have ten or fewer employees, you do not have to complete and post the OSHA form 300A. https://www.osha.gov/recordkeeping/new-osha300form1-1-04.pdf
If you are not exempted by type of business or number of employees, you must post the OSHA log 300A - summary of work-related injuries and illnesses - in an area accessible to all employees from February 1 to April 30 of each year. After that date, maintain the post in an OSHA file.
