I had a couple of calls already on the NAR settlement. I have not read the full settlement agreement yet but I will say that there are changes coming and they will come fast!
1. Listings will be at a premium!! Many buyers will choose to call the listing broker instead of paying a buyer broker themselves. I would guess that listing agents adapt and start charging 4 or 4 1/2% probably as they realize they will be showing the home themselves many many times.
2. Every broker must now have a buyer broker agreement signed. This is a good one. Once you have that signed, my preliminary understanding is that you still can put in an offer that says my buyer offers $400,000 with you the seller paying my 2 or 2 1/2% fee. One broker asked me but if my client is up against another offer from a buyer going through the listing broker, we will lose. That is true if the offer price is the same AND if the market stays like this. When the inventory and market get back to normal, the seller will welcome your offer!!!
3. Many different business models will pop up!! Some buyer brokers might try charging a flat fee per listing shown. Some listing agents will take listings and realize they are going to do all the showings or most by themselves but will get more organized. “We are showing that home on Wednesday from 5-7 or Saturday from 9-11.” No way brokers can run out on every call!
4. Be willing to adapt! Don’t get frustrated or feel you are out of business!!! Brush up on your listing presentations! Try new things! Explain what is going on in the market and be able to show your value as a buyer broker! Go the extra mile and I think you will be surprised.
5. If you are a buyer’s broker on a team, make sure you cover yourself!!! You will need to negotiate a fee in when your principal wants you to show 20 different buyers a home but none want to pay you themselves. And look at #3 which will save you time and may help create excitement around the home!

I get the question “How fast can we close?” often. Most of the time it is a cash deal when they are asking that question (otherwise ask the lender). So when things were VERY busy four months ago, it took two to three weeks to get a survey. Now we can get one in four days. So the answer is very fast UNLESS there is an association. The issue with an association is we need closing documents and we don’t want the seller to go through the expense of ordering those unless we have cleared Attoeney Review and Inspection. We cannot reuse those docs if the deal falls apart. Additionally keep in mind that there are rush fees when we order and need them in less than 7-10 days depending on the association. Now work backwards and remember we probably won’t even get an Attorney Approval Letter from the buyer’s attorney until day 5. Give us a day or two after that to reach an agreement and then 7-10 days after that. If there is no association, we could close one day after an agreement on AI right now! A survey can be reused so we don’t care as much if the deal falls as long as the seller is still planning on selling to someone else.
