Attention Truck Drivers and Carriers!
The FMCSA has updated the Clearinghouse regulations under the Clearinghouse 2 Final Rule. Here’s what you need to know:
✅ Key Updates:
• CDL drivers in a “prohibited” status in FMCSA’s CDL Drug and Alcohol Clearinghouse will now lose their State-issued commercial driving privileges until they complete the return-to-duty (RTD) process, as established by 49 CFR part 40, subpart O.
• Employers and owner-operators must query the Clearinghouse annually to check for violations in a driver’s drug and alcohol testing history.
• All positive test results remain in the Clearinghouse until they are cleared through the return-to-duty process.
• The rule also strengthens employer requirements for reporting violations.
