If you think that using foreign language terms is sophisticated and unique when developing a trademark...think again. When you submit your trademark application in the U.S. the Trademark Office will require you to translate the terms into English and then they will examine your application using the translated terms.

For example, Cocina Azul for your Mexican Restaurant, will be examined using the translated term Blue Kitchen. Be aware!

In the U.S., you can't receive a trademark registration unless you show that you are actually using it in commerce. What if you're developing your brand or business, and not using the trademark yet but want to keep others from using it?

Not a problem...the U.S. has a system where you can file an "Intent-to-Use" trademark application. If you have a "Bone fide" intent to use the trademark, you can "reserve" it (using that term loosely - it's not a reservation system) ...the trademark office will review the application and if all good, they will tentatively approve it.

Then when you actually start using the trademark in commerce, you submit a "Statement of Use" showing it being used in commerce; and then the trademark will Register. Easy-Peasy 😊

Many businesses like to use their personal names in association with their business. From a trademark this is not always the best choice. It will almost always get rejected at the trademark office if you try to register it.

The reason is it prevents others with the same or similar name from using it. Only if the name has "acquired distinctiveness" will it be recognized as having any trademark validity.

Did you know Trademarks are a sub-set of Intellectual Property (IP). They are an "intangible" asset. However, they have all the attributes of real ("tangible") property. Trademarks can be sold, leased, rented, mortgaged, used as collateral, passed on to heirs, gifted...anything you can do with real property, you can accomplish with trademarks, and other types of IP.

Filing for your own Trademark registration in the U.S. is super easy. If you take the time to do it once, I'd say maybe an hour at most, the next time it takes about 10-15 minutes. Yup. And I show you step by step with screen shots.

Unfortunately, if you're outside the U.S., you have to hire an U.S. attorney to do it for you. But we can still show you how to save big dollars!
