Recently, we at nucleiINDY helped secure an EB-1A approval for a young pipeline integrity engineer (under 30 years old) in a category often associated with decades-long careers. And that is why this approval means so much to us.

Here’s the kicker 🦵 — we achieved all of this while the client was still on STEM OPT, i.e., within three (3) years of graduating with a bachelor’s degree.

So what did we do 🤔

Despite being early in his professional career, we presented eligibility across five (5) criteria:
➡️ Leading and critical role
➡️ Original contributions of major significance
➡️ Judging the work of others (peer review)
➡️ Membership in distinguished associations (technical committee membership and participation)
➡️ Authorship of scholarly publications (including technical conference papers)

But then, there was that dreadful “NOID”! 😶

Although USCIS initially accepted three of the five criteria, it issued a Notice of Intent to Deny (NOID) based on the final merits determination — with a 33-day response window (and that too during Christmas 😤).

In most cases, acceptance of three (3) criteria is considered a win. But as someone once said, go the extra mile (Matthew 5:41 ✝️). So we did exactly that. We doubled down on eligibility across all five criteria because our response strategy focused on the interconnectedness of the client’s work:

• Leadership roles enabled the development of impactful engineering innovations.
• Those innovations generated industry adoption and peer recognition.
• Peer recognition resulted in judging appointments and selective association leadership roles.
• Judging and association participation reinforced the client’s technical authority.
• Scholarly authorship disseminated and validated the client’s contributions across the global engineering community.

And there you have it — an EB-1A approval.

So, why should this case matter to you? Extraordinary ability is about impact and influence, age is just a number, and you are limited only by your effort.

Tracking the surge of litigation against executive actions/initiatives such as the Trump “Gold Card” or "the $100,000 H-1B fee increase", I cannot help notice a reoccurring pattern - how “rule of law” rhetoric is selectively deployed.

Don't get me wrong: Opposing executive action is, of course, a legitimate part of our legal system. But when litigation becomes reflexive (hashtag ) aimed more at blocking policy outcomes than legitimate challenges to executive overreach — it starts to resemble lawfare rather than principled advocacy.

For me: If it is your "SHtick" to aggressively litigating one administration’s use of executive authority while ignoring materially similar exercises under others, you are not defending the rule of law — you are a tool, a political hack, and a useful idiot.

The rule of law demands consistency, not selective outrage.

Priority Date: Your place in line for a visa, usually the date when USCIS received your petition (or labor certification, if required).

Final Action Date: The cutoff date in the Visa Bulletin that determines when USCIS/DOS can issue a green card or immigrant visa.

📌 Until your priority date becomes earlier than the final action date listed for your category and country, you cannot be approved for a green card.

A common point of confusion in U.S. immigration law is the difference between Change of Status (COS) and Adjustment of Status (AOS).

🔹 Change of Status (COS): This occurs when an individual in the U.S. moves from one nonimmigrant classification to another without leaving the country. Example: an F-1 student transitions to an H-1B worker. Notably, the individual remains a nonimmigrant.

🔹 Adjustment of Status (AOS): This is the process of moving from non-immigrant status to immigrant (permanent resident) status, typically through an employment-based or family-based petition. Example: an F-1 student becomes a lawful permanent resident (green card holder).

👉 Key Distinction: COS preserves a temporary stay; AOS secures a permanent future in the U.S.

Understanding this difference is critical when planning long-term immigration strategies, as rights, obligations, and risks vary significantly between the two.
