The U.S. Court of Appeals for the D.C. Circuit ruled on April 28, 2026, that Oncor Electric Delivery Company was legally permitted to fire an employee for testimony given at a state legislative hearing, reversing a prior decision by the National Labor Relations Board. This marks the second time the D.C. Circuit has reversed the NLRB in this 13-year-old case. The court previously sent the case back to the Board in 2018 for failing to properly apply the "labor dispute" requirement, which the court concludes the Board still failed to do correctly on remand.
A U.S. appeals court on Tuesday said an electrical utility company was within its rights to fire an employee who testified about safety concerns with digital "smart meters" at a hearing of the Texas state legislature, reversing the National Labor Relations Board.
