You can be fined $1000 for your first offense with no warning if you are not in compliance.
Make sure you are in compliance if you are passing any kind of fee to your customers!
Under Dual Pricing, shelf tags, menus, and all other pricing materials, including itemized receipts, must either display both the card and cash prices or show only the card price. Please note that displaying only the cash price on any pricing materials or receipts is not permitted under any circumstances, even if signage attempts to clarify it. Signage alone does not make this compliant.
Signage disclosing the program should be posted at the Point of Entry and the Point of Sale.
Approved Signage: “All items have two prices, a List price and a Cash price. Customers are billed based on how they choose to pay.”
Merchant Talk Track: When asked if a fee is added to purchases, the answer is, “No, we do not add any fees to purchases. All our items have two prices, a card price and a cash price. Customers are billed based on how they choose to pay.”
Considerations for Dual Pricing:
Pricing Display: All items must show two prices – a List (Card) price and a Cash price. These should be clearly displayed on shelf tags, labels, menus, table checks or any other pricing materials. If only one price is shown, it must be the List price.
Billing at Checkout: Customers are charged based on their payment method. Cash payments are charged the Cash Price; all other payment methods are charged the List Price.
Receipts & Materials: Menus, shelf tags, and receipts must display either both prices or the List price. The Cash Price should never appear as the only price.
No Added Fees: Do not add separate fees to reach the List (Card) total – the price shown must already reflect the final amount due for non-cash payments.
