Summer Volume Four - Solar Panels & Your Title

What a UCC Filing Could Mean for Your Closing

A financed or leased solar-panel system can sometimes involve a creditor’s security interest in the equipment. Under Article 9 of the Uniform Commercial Code, a security interest can apply to personal property or fixtures, and a “fixture filing” is a financing statement covering goods that are—or will become—fixtures associated with real property.

That matters in a real estate transaction because an existing solar financing arrangement or UCC/fixture filing may need to be identified and addressed as part of the sale, payoff, transfer, or closing process. The exact treatment depends on the solar agreement, how the interest was filed, and applicable state law, so I would phrase the educational piece carefully rather than saying every solar system automatically creates a lien against the house.

This week, we’re talking about why a pre-listing title search matters.

Finding title issues before a property goes under contract can help prevent delays, reduce stress, and give sellers and Realtors more time to resolve potential problems before closing.

Liens, judgments, unreleased mortgages, ownership concerns, and recording errors are just a few issues that can surface during a title search—and the earlier we know about them, the better prepared everyone can be.

The best time to discover a title problem is before you have a buyer waiting to close.

Preparation creates confidence, and confidence creates smoother closings. 💙
