The Supreme Court just slapped down Trump’s attempt to erase birthright citizenship by executive order in a 6–3 ruling. Those numbers matter.

The 14th Amendment is not ambiguous. If you’re born here, you’re a citizen. Full stop. The 6‑justice majority did the bare minimum: they read the words, respected over a century of precedent, and said a president doesn’t get to rewrite the Constitution with the stroke of a pen.

The 3 dissenters—Thomas, Alito, and Gorsuch—chose politics over law. They pretended “subject to the jurisdiction thereof” is a magic escape hatch to deny citizenship to kids born here if their parents are immigrants or visitors. That’s not constitutional interpretation. That’s servicing a ‘nativist’ (let’s be real, it’s not even that for obvious reasons), anti‑immigrant agenda from the bench.

They leaned on fear-mongering buzz words like “birth tourism,” “national security,” and “foreign allegiance” to justify throwing some people’s rights in the trash while protecting others. That’s how you know this isn’t neutral judging—it’s targeted, it’s ideological, and it’s dangerous.

We should call this what it is: three justices signaling they’re willing to rip up basic, bedrock rights if it helps the movement they’re aligned with. They’re not “strict interpreters.” They’re political actors in robes, and their votes in this case prove it.

The win: birthright citizenship stands. The warning: we’re three votes away from losing rights most people thought were untouchable. That’s why organizing, court accountability, and showing up in every election actually matter. The far right is playing a long game with the courts. We have to be just as relentless in fighting back.
