UIF CLAIMS SOUTH AFRICA: UNDERSTANDING UIF MATERNITY BENEFITS, UIF ILLNESS BENEFITS AND UIF REDUCED WORKING TIME BENEFITS
One of the most common questions received by Labour Dynamix and UIF Help and Advice South Africa is:
"If my employer pays part of my salary during Maternity Leave, Illness Leave or Reduced Working Time, will UIF pay the balance?"
Many employees, employers, HR practitioners and even some UIF Consultants believe that UIF automatically pays the difference between what the employer pays and the employee's normal salary.
The Unemployment Insurance Act 63 of 2001 does not say this.
UIF MATERNITY BENEFITS
Section 24(3) of the Unemployment Insurance Act states:
"When taking into account any maternity leave paid to the contributor in terms of any other law or any collective agreement or contract of employment, the maternity benefit may not be more than the remuneration the contributor would have received if the contributor had not been on maternity leave."
UIF ILLNESS BENEFITS
Section 21(2) of the Unemployment Insurance Act states:
"When taking into account any sick leave paid to the contributor in terms of any other law, or any collective agreement or contract of employment, the illness benefit may not be more than the remuneration the contributor would have received if the contributor had not been ill."
UIF REDUCED WORKING TIME BENEFITS
Section 12(1B) of the Unemployment Insurance Act states:
"A contributor employed in any sector who loses his or her income due to reduced working time, despite still being employed, is entitled to benefits if the contributor's total income falls below the benefit level that the contributor would have received if he or she had become wholly unemployed, subject to that contributor having enough credits."
WHAT ABOUT UIF CREDITS?
Many contributors are unaware that not all UIF Benefits affect future claims in the same manner.
Section 13(5)(a) of the Unemployment Insurance Act states:
"The days of benefits that a contributor is entitled to in terms of subsection (3) may not be reduced by the payment of maternity benefits in terms of Part D of this Chapter."
Section 13(5)(b) further states:
"The payment of maternity benefits may not affect the payment of unemployment benefits."
This means that UIF Maternity Benefits receive special protection under the Unemployment Insurance Act and do not reduce a contributor's future unemployment benefit entitlement.
