HR Tip of the day: Employment Equity Compliance under the Amendment Bill

In terms of the amendments to the Employment Equity Act the criteria for designated employers (those that employ 50 or more employees) to ensure compliance will be :
- Submit Annual EE Report
- Comply with own Annual EE Targets towards the 5-year Sector EE Target;
- Comply with the National Minimum Wage (NMW)/ exemption granted not to pay NMW (previous 12 months);
- No CCMA Unfair Discrimination Award against employers (previous 12 months).

Fixed Term and Limited Duration management

After consulting for 24 years this year I am still faced with the reality of the renewal of Fixed Term and Limited Duration contract.

When I say renewal, I actually mean the absence of proactive management of renewal or timeous termination of such contracts. Almost on a daily basis I am faced with the responsibility of management of the termination of Fixed Term Contract or Limited Duration Contracts of Employment terminations just to find that the contract has in fact terminated somewhere in 2022 or 2023.

When we enter into term type contracts, we accept the responsibility for the fact that reasonable expectation of renewal or some form of permanency is managed at all times. Somehow managing such expectation seems to unfortunately fall by the wayside whilst equally important we fail to prioritise the management of the notice in terms of termination of the contract or the pending renewal. This often leads to a contract “rolling” and renewing itself, often for more than a year or two. This raises the question of how we manage reasonable expectation in terms such automatic renewal/rolling of the contract.

Undoing such expectations on the back of a planned termination of the agreement becomes hugely problematic as it is almost a fait accompli that a dispute will arise.

As employers we have the responsibility to ensure that the duration and termination of such contracts are managed proactively. We also have to vigilant that expectation, outside of automatic renewal of the agreement as mentioned above, is not created by our employees and have to ensure that we constantly remind the fixed term employee of the nature and duration of their agreement.

President Cyril Ramaphosa has proclaimed Wednesday, 29 May 2024 as the date for the general national and provincial elections. For this purpose, the President has also declared an additional public holiday on 29 May 2024, in terms of section 2A of the Public Holidays Act 36 of 1994.

Please take note of this new Public Holiday as this will have an impact on payroll especially for shift workers.

Employers are reminded that the minimum wage in South Africa has increase by 8,5% from R25,42 to R27,58 per hour as of 1 March 2024.

It is important for employers to continuously comply with labour law, including any amendments and corrections by the Department of Labour as in this case. It is therefore necessary that you adjust the national minimum wage rate that your employees will receive as of this month (1 March 2024) according to the amended national minimum wage.

An employer who is found to have failed to comply with the NMW will be fined by a labour inspector an amount equal to twice the value of the underpayment or twice the monthly wage, whichever is greater for first offenders and an amount equal to thrice the value of the underpayment or thrice the monthly wage, whichever is the greater, for repeat offenders.
