No misuse. No leak. No dishonesty proven. She was debarred anyway.

A financial adviser at Affinity Life has had her debarment upheld by the Financial Services Tribunal - after emailing a spreadsheet of client data to her personal Gmail account.

The spreadsheet contained client names, ID numbers, policy numbers and premium details. She called it her personal "stats sheet," used to re-engage lapsed clients. But the data reportedly went further than her own book, including records dating back to 2018 and clients belonging to other representatives.

The adviser argued the breach shouldn't count: she'd only sent it to herself, never disclosed or misused it, and there was no proof any client was harmed. She deleted it and cooperated fully once the company found out.

The Tribunal rejected that defense outright. Its finding: integrity doesn't require dishonesty. Simply removing confidential client information from a secure, controlled environment, without permission, and without a properly explained reason - is enough on its own to breach the trust the role requires. Proof of actual misuse isn't necessary; the exposure itself is the harm.

The transfer happened while she was under performance review and pursuing a role at another firm.

The takeaway: "I didn't misuse it" isn't a defense once data leaves a controlled environment. If your policy relies on trusting good intentions rather than controlling where data can go, this ruling shows exactly where that assumption breaks down.
