The Independent Commission for Human Rights wishes to inform the public that we will officially close on 12 December 2025 for the festive season. Date yoba sisebenze futhi will be announced.

During this period, the Commission will only attend to emergency GBVF (Gender-Based Violence and Femicide) matters. All other services will resume upon reopening.

As the year comes to an end, we extend our warmest wishes to the people of South Africa. May this festive season bring you peace, safety, joy, and quality time with your loved ones.

🚨UNFAIR ALLOWANCES OF OUR SANDF HEROES🚨

The Independent Commission for Human Rights expresses deep concern over the shocking allowance rates received by our brave SANDF soldiers deployed in high-risk combat zones(DRC).

For nearly 25 years, the official danger allowances have remained unchanged, leaving our heroes earning:

R19.63 per day – Danger Allowance

R29.39 per day – Special Danger Allowance

These figures are painfully low for men and women risking their lives.

We are further alarmed by the major funding discrepancy between the allowance amounts reportedly allocated by SADC for deployed soldiers and what soldiers actually received. While allocations were understood to be around R25,000 per month per soldier, many soldiers reportedly received only R7,000 to R12,000 total over several months.

Our soldiers deserve transparency.
They deserve fairness.
They deserve dignity.

The Commission respectfully appeals for urgent attention to this matter, not as a demand, but as a plea for justice for those who protect our nation with courage and honour.

🚨PUBLIC STATEMENT🚨

The Independent Commission for Human Rights (ICHR) hereby confirms the removal of Mr. Kosi from his position as National Legal Department Head.

This action follows reports that he allegedly requested fees or financial favours from individuals seeking assistance. The Commission wants to make it clear that ICHR services are 100% free, and no member has the authority to ask the public for money under any circumstances.

The ICHR Executive had no knowledge of any funds or payments linked to Mr. Kosi, and such conduct—if proven—amounts to serious misconduct and goes against the ethical standards of the Commission.

Regarding the Man B case, the matter was assigned to him based on his claim of being an advocate who could assist workers. Unfortunately, his actions did not align with the Commission’s mandate of protecting and promoting human rights with honesty and integrity.

For transparency:
Only Deputy President Ms. S. Mbalo and Deputy National Commissioner Mr. M. Makeleni can make decisions about donations.
No Commissioner may handle donations or request money from the public.

This statement is released to protect the credibility of the Commission and to assure the public that we remain committed to clean, ethical, and transparent human rights work.

The ICHR continues to stand firm with our people, serving without fear, favour, or corruption.

🚨APPEAL TO THE HONOURABLE PREMIER OSCAR MABUYANE REGARDING OUTSTANDING INTERNS’ STIPENDS🚨

The Independent Commission for Human Rights wishes to express its respect to the Honourable Premier of the Eastern Cape, Mr. Lubabalo Oscar Mabuyane, and acknowledge his recent intervention to resolve delayed stipend payments for thousands of young beneficiaries in the provincial Skills Development Programme.

We appreciate the commitment shown by the Premier’s Office in protecting the interests of the youth. However, we respectfully bring to the Premier’s attention that a number of interns remain unpaid for October and November, despite the corrective measures announced. Their names and outstanding amounts have been compiled in the attached document.

Total amount owed to all listed beneficiaries:
R747,340.00

We humbly request the Premier’s assistance in ensuring that these remaining payments are finalised urgently so that no beneficiary is left behind or financially disadvantaged.

The commission wrote to the Office of the Premier and will wait for correspondence.

The Commission stands ready to assist and cooperate in any way necessary.

Regarding the Passing of Witness D (Mr. Marius van der Merwe)

The Independent Commission for Human Rights extends its deepest and most heartfelt condolences to the family, friends, and colleagues of Mr. Marius van der Merwe, known publicly as Witness D at the Madlanga Commission.

We are deeply saddened and concerned by his tragic passing. Mr. van der Merwe was killed in Brakpan after giving critical testimony against high-ranking EMPD officials. His bravery in exposing corruption should have been met with protection — not with fatal consequences.

A CRITICAL QUESTION: Why Was He Not Protected?

South Africa has clear legal provisions that require the State to protect individuals who testify against organised crime, corruption, or any matter that places their life in danger.

LEGAL BASIS FOR WITNESS PROTECTION

Under the Witness Protection Act 112 of 1998, the State is obligated to ensure the safety of witnesses whose lives are at risk because of their testimony.
The Act states:

Section 7(1): A witness “must be placed under protection if the Director (of Witness Protection) is satisfied that their safety is threatened or that they may be harmed as a result of giving evidence.”

Section 2: Establishes that witness protection exists “to enable such persons to testify freely, without fear, and in the interest of justice.”

If a witness, especially one testifying against senior officials, is exposed to danger, the State has a legal and moral duty to intervene.

The Commission strongly condemns the circumstances that led to the death of Mr. van der Merwe.
His passing raises urgent questions:

❌Why was a key witness testifying against powerful individuals not placed under protection?

❌Were risk assessments conducted?

❌Was any formal request for protection made or ignored?

❌Who failed in their duty to protect him?

Closing Condolences

To the family of Mr. van der Merwe:
We honour his courage, and we stand with you in your grief. His sacrifice must not be in vain, and his testimony must continue to open the path to justice.

May his soul rest in peace, and may justice be served.

🇿🇦Crimen Injuria case successfully opened 🇿🇦

The Independent Commission for Human Rights confirms that a Crimen Injuria case has been officially opened today at Vulindlela Police Station, Mdantsane by our Provincial Legal Department Head, Mr. Z. Gxalatane.
The matter is registered under CAS 31/12/2025.
Other charges may be added.

This follows false, defamatory and dignity-violating statements made by Mr. Lunga Ngcabashe, accusing the Commission of fraudulent activity without any evidence. Such allegations directly harm the integrity and reputation of the Commission and undermine the work we do for communities across South Africa.

We further state that any additional posts, videos, or content published by Mr. Ngcabashe using the Commission’s name, logo, or reputation will be added as further evidence and will be used against him in a court of law.

The Commission remains committed to transparency, accountability, and protecting the dignity of its members and beneficiaries.
