While conducting a site inspection, I encountered this serious lifting non-compliance:

โŒ Using an excavator bucket as a lifting point
โŒ Slings wrapped over bucket teeth โ€“ a major risk for sling failure
โŒ No proper lifting plan or visible taglines to control the load
โŒ Questionable scaffold safety around the load zone

These practices place workers' lives in immediate danger and violate basic lifting and rigging safety standards.

๐Ÿ” Can Clients Fine Contractors for OHS Non-Compliance? Here's the Legal Truth.

In South Africa, clients cannot legally fine contractors for OHS non-compliance under the Occupational Health and Safety Act (85 of 1993). Only the Department of Employment and Labour can impose statutory fines.

๐Ÿšจ But hereโ€™s the catch:
Contractual fines are allowed.
If the contract between the client and contractor specifically includes OHS penalty clauses, the client can issue financial penalties for non-compliance. These are civil, not criminal, and must comply with the Conventional Penalties Act 15 of 1962.

โœ… Key points to remember:

Penalties must be reasonable and proportional.

Clients should clearly outline these clauses in the OHS agreement or service-level contract.

Without a written clause, clients cannot simply impose fines.

While conducting an OHS inspection on a contractor site this week, we came across this scaffolding setup โ€” and it raises serious red flags under SANS 10085:2024.

Hereโ€™s what we found:
๐Ÿ”ด No toe boards or mid-rails โ€“ major fall & drop hazard
๐Ÿ”ด No base plates or sole boards โ€“ unstable footing
๐Ÿ”ด Missing access ladders โ€“ unsafe climbing
๐Ÿ”ด Poor bracing & no ties โ€“ lateral collapse risk
