Most people think a rooster simply climbs on a hen... and that's where the story ends. But what actually happens inside the hen is incredible.

This diagram shows what happens during and after mating.

When a rooster mates with a hen, s***m enters through the cloaca, a single opening used for reproduction.

The s***m then travels up the hen's oviduct, where it can survive for up to two weeks. That means one successful mating can fertilize several eggs, not just one.

At the same time, the hen's o***y contains eggs at different stages of development.

As each yolk is released, it travels through the oviduct, where it can be fertilized before the egg white, membranes, and shell are formed.

That's why a hen can continue laying fertile eggs for days after just one mating.

Nature has designed chickens with an incredibly efficient reproductive system.

Understanding the Courts' Approach to Distress for Rent

One of the recurring issues in landlord and tenant disputes in Zambia is the remedy of distress for rent. While the remedy has long existed in law, recent judicial decisions have clarified the extent to which it may be exercised under the Rent Act, Chapter 206 of the Laws of Zambia.

Section 14 of the Rent Act provides that:

"No distress for recovery of rent in respect of any premises shall be levied except with the leave of the Court."

Although the provision is brief, recent decisions have provided useful guidance on its interpretation and application.

In Samuel v Chaponda & Others (2014), the High Court considered the consequences of levying distress without first obtaining leave of the Court. The Court held that distress undertaken without judicial approval was unlawful, resulting in liability for the landlord arising from the seizure and disposal of the tenant's property. The decision also recognised that those involved in carrying out an unlawful distress may bear legal responsibility.

In Francis Mutota v Memory Goldwin (2023), the Subordinate Court examined the wording of section 14 and emphasised the mandatory nature of the provision. The Court interpreted the use of the word "shall" as leaving no discretion as to the requirement for prior leave of the Court before distress may lawfully be levied.

More recently, Azurite Properties Limited v Sammy Chibangu (2024) demonstrated the evidential burden associated with an application for leave to levy distress. While the Court acknowledged its jurisdiction to grant leave under section 14, the application was declined because the applicant failed to establish ownership of the motor vehicle sought to be attached.

Taken together, these decisions contribute to a developing body of Zambian jurisprudence on distress for rent. They illustrate that the courts continue to interpret section 14 as a statutory safeguard that places the exercise of distress.
