The latest AML compliance update highlights the importance of staying current with the FATF’s High-Risk Jurisdictions subject to a Call for Action (“Black List”) and Jurisdictions under Increased Monitoring (“Grey List”).

A change in a country’s FATF status can affect customer risk assessments, due diligence requirements, transaction monitoring, existing customer reviews, and AML/goAML reporting.

Businesses should review:

1. Customers and transactions linked to High-Risk Jurisdictions

2. Customers and transactions linked to Jurisdictions under Increased Monitoring

3.Existing customer risk assessments and due diligence

Free Zone or Designated Zone? They're not the same, and there is no single "Designated Zone" status for all UAE taxes.

The FTA's Public Clarification TAXP010 explains that the treatment depends on the relevant Tax Law, so businesses must assess their status separately for Corporate Tax, VAT and Excise Tax.

🔹 Corporate Tax: distribution qualifies for 0% only when it is conducted in or from a Corporate Tax Designated Zone.
🔹 VAT: a VAT Designated Zone may be treated as outside the UAE for certain supplies of goods. Not all transactions in the zone are outside VAT.

Missed a Corporate Tax deadline? It happens even to well-run businesses.

One of our Dubai SME clients faced a AED 10,000 penalty after missing their UAE Corporate Tax registration deadline.

We acted swiftly, and:

Reviewed their compliance history to assess waiver eligibility

Confirmed eligibility and built their case under the FTA's penalty waiver initiative

Completed their registration and set them on track to file within the 7-month window required for waiver eligibility

Few weeks later, the penalty was waived - in full.

Lesson: Late registration penalties may be waived if you meet the FTA's eligibility conditions - but you need to act fast.
