Uber Drivers Be warned when lodging a claim using AI !!!

The Fair Work Commission (FWC) and tribunals are currently facing a significant "unsustainable" surge in claims, largely attributed to unrepresented workers—including Uber drivers—using generative AI to file applications.

The "AI Slop" Crisis
Surge in Filings: The FWC has seen an unprecedented jump in its workload, with forecasts predicting up to 55,000 filings for 2025–26, a record level that shows no signs of slowing down.

Inaccurate Information: FWC President Justice Adam Hatcher has warned that AI-generated materials are frequently incorrect, incomplete, or entirely made up. This has led to "unmeritorious" claims where AI gives applicants unrealistically optimistic views of their success.

"Hallucinations" in Court: In specific cases, workers have relied on AI that invented contract terms, misinterpreted laws, and provided non-existent case citations. One Queensland worker faced a rare potential costs order for relying on such "egregious" AI hallucinations.

New Rules and Penalties
To address this, the Commission and courts have introduced strict new measures:

Mandatory Disclosure: New rules require applicants to disclose if AI was used to prepare their documents.

Cost Consequences: While the FWC is traditionally a "no-costs" jurisdiction, it is now issuing warnings that relying on unverified AI material can lead to costs orders against the applicant to pay for the other side's legal fees.

Many Uber Drivers Are Now Lodging Their Own Applications Using AI – And It’s Creating Serious Problems

We are now seeing increasing numbers of drivers across Australia and New Zealand lodging Fair Work and tribunal applications themselves using AI-generated documents.

Unfortunately, many applications are being filed:
• without proper submissions
• without supporting evidence
• outside critical deadlines
• or without understanding tribunal procedures

In many cases, drivers only realise the seriousness of the situation after receiving procedural directions, objections, or dismissal notices.

Hey guys, due to ongoing delays across Australian tribunals and a significant increase in workload from new client appeals, we have now reached a point where demand is exceeding our current capacity.

To ensure every matter receives the level of attention and preparation it requires, we are now restricting our weekly intake to a maximum of 4 new unfair dismissal applications.

This limit is strictly enforced.

Once capacity is reached for the week, no further matters will be accepted until the following intake period.

Rising Issues with Account Lockouts and Missing Earnings – Client Cases Increasing

I’ve recently been dealing with a growing number of enquiries from clients involving a similar and concerning situation.

In these cases, individuals report that their accounts have been unexpectedly locked following suspected security breaches or account compromise. In several instances, earnings have already been withdrawn or become inaccessible before the account was secured.

A common theme I’ve observed is that clients attempt to resolve the issue by following support instructions, including updating contact details or account credentials to restore security. However, these same corrective actions can sometimes trigger additional system flags, such as duplicate account or identity verification issues, which then result in further restrictions being placed on the account.

The outcome is often a frustrating cycle where access to the account is restricted, funds remain unresolved, and clear communication around the status of earnings is limited or delayed.

I’m sharing this because it appears to be an emerging issue affecting multiple users, particularly where accounts have been compromised and recovery steps are being followed in good faith.

It raises broader questions about how account recovery processes and financial protections are managed in situations involving suspected unauthorised access.
